Despite this subsection, this Act does not apply to lieutenant governors, judges who are paid a salary under the Judges Act, military judges appointed under section 165.21 of the National Defence Act and prothonotaries appointed under section 12 of the Federal Courts Act.

7. For greater certainty, payments of allowances made before the coming into force of this Act to judges of the Supreme Court of the Yukon Territory and the Supreme Court of the Northwest Territories under subsection 27(2) of the Judges Act and to judges of the Federal Court under subsection 27(3) of that Act, as those subsections read immediately before the coming into force of this Act, are authorized.
7. However, if we add the definition that is in clause 1.1 as a parenthetical definition after the word “marriage” wherever it appears in Bill C-23, then as Bill C-23 amends each of these acts that definition will be carried into each of those acts, so that judges, administrators and parliamentarians, when they are dealing with specific sections of a pension bill, the Income Tax Act, the Judges Act, the Members of Parliament Retiring Allowances Act, or whichever act it is of the 68 statutes involved, that definition would be front and centre before these people who are dealing with these acts on a daily basis.

In accordance with the first paragraph of Article 17 of the Statute and the first paragraph of Article 5 of Annex I to the Statute, if, in the Chamber of five Judges or in the full court, there is an even number of Judges, as a result of a Judge's being absent or prevented from acting, the Judge who is the first in the reverse order to that provided for in Article 6 shall abstain from taking part in the deliberations, unless he is the Judge-Rapporteur.
