Stresses that the reform of the Turkish judiciary system is central to the efforts to bring about democratic consolidation in Turkey and an indispensable prerequisite for Turkey’s modernisation, and that such reform must lead to a modern, efficient, fully independent and impartial judicial system guaranteeing due process of law for all citizens; welcomes the third judicial reform package as a step towards a comprehensive reform process in the area of the judiciary and fundamental rights; stresses, however, the crucial importance of continuing the reform process by (a) addressing the excessively broad definition of criminal offences and, in particular, what constitutes an act of terrorism under the Penal Code or the Anti-Terror Law, with the urgent need to introduce a clear distinction between, on the one hand, the promotion of terrorism and the incitement to violence and, on the other hand, the expression of non-violent ideas, in full compliance with ECtHR case law, in order to safeguard freedom of expression, freedom of assembly, including student protests, and freedom of association; (b) addressing the issue of excessively long pre-trial detention periods; (c) addressing the need to allow full access to the prosecution file for defence lawyers; (d) setting criteria to promote the quality and consistency of evidence; and (e) reviewing the role and scope of special courts; welcomes, in this regard, the adoption of the fourth reform package by the TGNA and looks forward to its speedy implementation;
9. insiste sur le fait que la réforme du système judiciaire turc est essentielle pour le renforcement de la démocratie, qu'elle est un préalable indispensable à la modernisation du pays et qu'elle doit aboutir à la mise en place d'un système moderne, efficace, pleinement indépendant et impartial garantissant le respect des procédures judiciaires pour l'ensemble des citoyens; se félicite du troisième train de réformes judiciaires, qui marque une étape sur la voie d'une réforme globale de la justice et des droits fondamentaux; souligne cependant qu'il est primordial que la Turquie poursuive les réformes a) en révisant la définition excessivement large des infractions pénales et notamment des éléments constituant un acte de terrorisme au sens du code pénal et de la loi sur la lutte contre le terrorisme, étant entendu qu'il est urgent d'établir une nette distinction entre l'apologie du terrorisme et l'incitation à la violence, d'une part, et l'expression d'idées non-violentes au sens de la jurisprudence de la Cour européenne des droits de l'homme, d'autre part, afin de préserver la liberté d'expression, la liberté de réunion, y compris les manifestations d'étudiants, ainsi que liberté d'association, b) en trouvant une solution au problème des périodes de détention préventive excessivement longues, c) en donnant aux avocats de la défense un accès total aux dossiers d'accusation, d) en fixant des critères sur la qualité et la cohérence de la preuve et e) en redéfinissant le rôle et la compétence des tribunaux spéciaux; se félicite, à cet égard, de l'adoption par la Grande Assemblée nationale de Turquie du quatrième train de réformes, dont il espère une application rapide;

The world-wide anti-terrorism alliance must certainly address military issues to ensure safety, but it must also address all the possible forms of terrorism which exist, which range from financial to banking terrorism, and from economic, food contamination and environmental terrorism to electronic terrorism and terrorism in the form of computer hacking.
