Article 144. 1 of the Commission Delegated Regulation (EU) No 1268/2012 on the rules of application of Regulation (EU, Euratom) No 966/2012 is moved up as new Article 108.4a of the Regulation (EU, Euratom) No 966/2012 on the financial rules applicable to the general budget of the Union, on the circumstances to be taken into account when imposing exclusion and its duration and/or financial penalties.

The institutions of the Union and any Member States which so desire may engage in a joint procurement procedure conducted pursuant to the third subparagraph of Article 104(1) of Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25 October 2012 on the financial rules applicable to the general budget of the Union and pursuant to Article 133 of Commission Delegated Regulation (EU) No 1268/2012 of 29 October 2012 on the rules of application of Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council on the financial rules applicable to the general budget of the Union , with a view to the advance purchase of medical countermeasures for serious cross-border threats to health.

Les institutions de l’Union et les États membres qui le souhaitent peuvent engager une procédure conjointe de passation de marché, menée conformément à l’article 104, paragraphe 1, du règlement (UE, Euratom) no 966/2012 du Parlement européen et du Conseil du 25 octobre 2012 relatif aux règles financières applicables au budget général de l’Union et en vertu de l’article 133 du règlement délégué (UE, Euratom) no 1268/2012 de la Commission du 29 octobre 2012 relatif aux règles d’application du règlement (UE, Euratom) no 966/2012 du Parlement européen et du Conseil relatif aux règles financières applicables au budget général de l’Union , en vue de l’achat anticipé de contre-mesures médicales relatives à des menaces transfrontières graves sur la santé.

He shall follow the same budget lines and administrative rules as applicable in the part of Section III of the EU budget which falls under Heading V of the Multiannual Financial Framework;

In order to ensure the efficient processing of applications for compulsory licences under this Regulation, Member States should have the ability to prescribe purely formal or administrative requirements, such as rules on the language of the application, the form to be used, the identification of the patent(s) and/or supplementary protection certificate(s) in respect of which a compulsory licence is sought, and rules on applications made in electronic form.
Afin de garantir un traitement efficace des demandes de licence obligatoire effectuées en vertu du présent règlement, les États membres devraient être en mesure d'imposer des critères purement formels ou administratifs tels que des règles relatives à la langue dans laquelle la demande doit être introduite, le formulaire à utiliser, l'identification du/des brevet(s) et/ou du/des certificat(s) complémentaire(s) de protection pour lesquels une licence obligatoire est demandée et des règles applicables aux demandes introduites sous forme électronique.
