Welcomes the fact that after the former Head of the Legal Service left the Agency in June 2012 to join a US-based law firm having a number of pharmaceutical industry companies as clients as senior counsel, the Executive Director of the Agency launched a review of his work as Head of the Legal Service, Chair of the Joint Committee, Chair of the Disciplinary Committee and as a member of the Advisory Committee on Procurement and Contracts; acknowledges that no evidence of conflicts of interest nor breach of obligations provided in Articles 11 and 11a of the Staff Regulations could be identified; welcomes the fact that in accordance with Article 16 of the Staff Regulations, the Executive Director imposed some restrictions to the activities of the former Head of Legal Service for a period of two years following his leaving the Agency; calls on the Agency to provide the discharge authority with detailed information on those restrictions;

Recalls that the Financial Regulation and implementing rules which entered into force on 1 January 2003 modified the procedures for planning, publishing and attributing procurement contracts, as well as abolishing the CCAM (advisory committee on purchasing and contracts) consultation of which was obligatory for contracts above EUR 50 000;

Acknowledges that the Secretary-General now provides the Committee on Budgetary Control with the quarterly reports of the ACPC (Advisory Committee on Procurements and Contracts) as requested in its decision of 4 April 2001; notes that according to the Annual Report for 2000 by the ACPC there is a continuing trend towards competitive tendering for the award of contracts compared to the conclusion of contracts by private treaty or negotiated procedures, as shown in the following table, but regards the level of non-competitive contracts as still too high:

(7) In its Communication on a Community programme in the field of safety, hygiene and health protection at work (1996-2000), the Commission stressed the need to streamline the operation of the two advisory committees - the Advisory Committee for Safety, Hygiene and Health Protection at Work and the Safety and Health Commission for the Mining and Other Extractive Industries - by merging them, reducing the number of members and giving them a single secretariat.
(7) Dans sa communication sur un programme communautaire dans le domaine de la sécurité, de l'hygiène et de la santé sur le lieu de travail (1996-2000), la Commission a souligné qu'il convenait de rationaliser le fonctionnement des deux Comités consultatifs, à savoir le Comité consultatif pour la sécurité, l'hygiène et la protection de la santé sur le lieu de travail et l'Organe permanent pour la sécurité et la salubrité dans les mines de houille et les autres industries extractives, en procédant à la fusion de ces comités, en réduisant le nombre de leurs membres et en les dotant d'un secrétariat unique.

(8) The communication from the Commission on "Adapting to change in work and society: a new Community strategy on safety and health 2002-2006" also notes that effective implementation of Community law requires close cooperation between the Commission and the Member States' administrations and that this cooperation would be better and simpler if the two advisory committees were to be merged into a single Advisory Committee.
(8) La communication de la Commission intitulée "S'adapter aux changements du travail et de la société: une nouvelle stratégie communautaire de santé et sécurité 2002-2006" constate d'ailleurs qu'une mise en oeuvre efficace du droit communautaire repose sur une coopération étroite entre la Commission et les administrations responsables dans les États membres et que cette coopération serait améliorée et simplifiée si les deux Comités consultatifs dans un seul Comité consultatif.

It was decided to establish an internal Advisory Committee on Procurement and Contracts (ACPC), which has to be confirmed by the MB.
