A. whereas on 4 March 2009 the ICC's Pre-Trial Chamber issued an arrest warrant against Sudan's President Omar Hassan al-Bashir in connection with alleged crimes against humanity and war crimes in Sudan's conflict-ridden province of Darfur,

Urges all Member States to collaborate fully in international criminal justice mechanisms, and especially in bringing fugitives to justice; in this regard, notes with satisfaction the cooperation of the Democratic Republic of the Congo in the transfer of Germain Katanga to the ICC, the cooperation of Serbia in the arrest and transfer of Zdravko Tolimir to the International Criminal Tribunal for the former Yugoslavia (ICTY) and the cooperation of Serbia and Montenegro in the arrest and transfer of Vlastimir Đjorđjević to the ICTY; however, notes with concern the persistent failure of Sudan to cooperate with the ICC by arresting and transferring Ahmad Muhammad Harun and Ali Muhammad Ali Abd-Al-Rahman; notes with concern that the ICC warrants for the arrest of four members of the Lord's Resistance Army in Uganda have not yet been executed; also notes with concern that Radovan Karadžić and Ratko Mladić remain at large and have not been brought before the ICTY; in this regard, calls on the Serbian authorities to ensure full cooperation with the ICTY, which should lead to the arrest and transfer of all remaining indictees, in order to open the way to the ratification of a Stabilisation and Association Agreement; considers further that the current proceedings brought against Liberia's former President, Charles Taylor, by the Special Court for Sierra Leone in The Hague constitute a significant development towards the ending of impunity;
prie instamment tous les États membres de participer sans réserves aux mécanismes de la justice pénale internationale, particulièrement en déférant les fugitifs devant les juridictions; relève avec satisfaction, à cet égard, le rôle joué par la République démocratique du Congo dans le transfert de Germain Katanga à la CPI, l'action de la Serbie dans l'arrestation et le transfert de Zdravko Tolimir devant le Tribunal pénal international pour l'ex-Yougoslavie (TPIY), ainsi que la participation de la Serbie et du Monténégro à l'arrestation et au transfert de Vlastimir Đjorđjević devant le TPIY; observe toutefois avec préoccupation que le Soudan ne coopère toujours pas avec la CPI en vue de l'arrestation et du transfert d'Ahmed Mohammed Haroun et d'Ali Mohammed Ali Abd-Al-Rahman; relève avec préoccupation que les mandats d'arrêt délivrés par la CPI contre quatre membres de l'Armée de résistance du Seigneur (Lord's Resistance Army) en Ouganda n'ont toujours pas été exécutés; déplore également que Radovan Karadžić et Ratko Mladić, toujours en liberté, n'aient pas encore été déférés au TPIY; demande, à ce sujet, aux autorités serbes de garantir une pleine coopération avec le TPIY, ce qui devrait conduire à l'arrestation et au transfèrement de toutes les personnes encore inculpées, afin d'ouvrir la voie à la ratification d'un accord de stabilisation et d'association; estime, en outre, que la procédure en cours devant le Tribunal spécial de La Haye pour la Sierra Leone contre Charles Taylor, ancien président du Libéria, représente un pas important vers la fin d'une situation d'impunité;

To ensure coherence with the political commitments expressed by the EU on the fight against terrorism (Seville Presidency Conclusions, 21-22 June 2002), cooperation in countering the proliferation of weapons of mass destruction (Council Conclusions of 17 November 2003) and support to the International Criminal Court (Common Position 2003/444/CFSP of 16 June 2003 and Thessaloniki Presidency Conclusions, 19-20 June 2003).
