Every pre-retirement benefit period established under these Regulations in respect of an employee shall commence with the date on which his unemployment insurance benefit period is terminated and shall terminate when he attains the age of 65 years, or on the date on which he becomes eligible to receive retirement pension under the Canada Pension Plan or the Quebec Pension Plan, whichever is the earlier.

The increase shall also be granted in the event of death, if the official has remained in service beyond the age at which he became entitled to a retirement pension.

(3) Where a person referred to in subsection (1) elected or elects under subsection 3(1) of The Civil Service (Transferred Employees) Act, 1956 of Newfoundland or subsection 3(1) of The Civil Service Transferred Employees Act, 1978 of Newfoundland to receive the pension specified in paragraph (b) of that subsection, there shall be paid to him, in respect of his service with the Government of Newfoundland and, in addition to any other payment to which he is entitled under the Act, a fraction of the pension related to his Newfoundland service that would have been payable to him had he retired upon reaching 60 years of age, such fraction to be determined as follows:

Where an official, on terminating his service, is entitled to a severance grant, this grant shall be reduced by the amount of the payments made under Article 42 of the conditions of employment of other servants; where he is entitled to a retirement pension, his pension rights shall be reduced in proportion to the payments made under that Article'.

Where the official, being entitled to a retirement pension, does not repay the sums referred to in the first paragraph, a capital sum representing the actuarial equivalent of his retirement pension as at the date on which such pension ceased to be paid to him, plus compound interest at the rate of 3,5 % per annum, shall be paid to him in the form of a deferred retirement pension payable at the age when he ceases to perform his duties.

The amount of the widow's pension shall in no case, however, exceed the amount of the first payment of the retirement pension to which the former official would have been entitled assuming that, had he stayed alive and exhausted his rights to one or other of the abovementioned allowances, he would have been entitled to a retirement pension.
