Any power, duty or function of the Minister under this Act, other than the power to make orders under section 10 and to authorize under this section, may be exercised or performed by any officer or employee of the Agency authorized by the Minister to do so and, if so exercised or performed, shall be deemed to have been exercised or performed by the Minister.

Where organisations, for which the competent authority will be the Agency in accordance with Article 3, have applied to a national supervisory authority of a Member State for the issue of a certificate before the date entry into force of this Regulation, the national supervisory authority shall finalise the certification process in coordination with the Agency and transfer the file to the Agency upon the issue of the certificate.
3. Lorsqu’un organisme ayant, conformément à l’article 3, l’Agence pour autorité compétente a introduit une demande de délivrance de certificat auprès d’une autorité nationale de surveillance d’un État membre avant la date d’entrée en vigueur du présent règlement, l’autorité nationale de surveillance finalise le processus de certification en coordination avec l’Agence et transfère le dossier à l’Agence une fois le certificat délivré.

The European Parliament and the Council should consider that proposal in order to ensure that European Supervisory Authority (European Securities and Markets Authority) (hereinafter the Authority’) will have adequate supervisory powers over credit rating agencies, bearing in mind that the Authority should execute exclusive supervisory powers over Credit Rating Agencies entrusted to it in Regulation (EC) No 1060/2009.
