If, after accepting a transportation plan under section 6 and making orders under section 7 or 8 in respect thereof, the Agency is given reason to believe that the provisions of the transportation plan are not being carried into effect at the times and in the manner prescribed by the plan, any amounts that may be applied or recommended for payment by the Agency under this Act may be withheld by the Agency or the Minister of Transport until the Agency is satisfied that all reasonable efforts are being made to carry the plan into effect at the times and in the manner prescribed by the plan.

7. In the framework of the budgetary procedure, the budget authority shall authorise the appropriations for the subsidy to the Agency and shall adopt the establishment plan for the Agency, which shall appear separately in the establishment plan of the Commission.

For the purposes of implementing these new tasks of preventing and responding to pollution, the Administrative Board of the Agency adopted on 22 October 2004 an Action Plan for Oil Pollution Preparedness and Response, which determines the Agency's oil pollution response activities and is aimed at optimum use of the financial resources available to the Agency (hereinafter ‘the Action Plan’).
