Member States shall determine the penalties applicable to infringements of this Regulation and shall take all measures necessary to ensure that it is implemented. The penalties provided for must be effective, proportionate and dissuasive. IN-CONTEXT TRANSLATIONS

1. The Agency shall operate under the authority and the political supervision of the Council, to which it shall provide reports and from which it shall receive guidelines or guidance in relation to the work of the Agency, notably with regard to its three-year Planning Framework.

(b) regarding the investigation of maritime accidents in accordance with Directive 2009/18/EC of the European Parliament and of the Council; the Agency shall, if requested by the competent Member States, provide support to the Member States in the conduct of investigations related to serious maritime accidents, and it shall carry out analysis of accident investigation reports with a view to identify added value at EU level in terms of lessons to be learnt. In this connection, the Agency shall be invited to assist the Member States during accident investigations involving (costal and offshore) maritime installations including accidents affecting oil and gas installations while the Member States shall be invited to cooperate in a full and timely manner with the Agency;
(b) concernant les enquêtes sur les accidents maritimes en application de la directive 2009/18/CE du Parlement européen et du Conseil; l'Agence prête assistance aux États membres, à la demande de ces derniers, dans la conduite des enquêtes liées à des accidents maritimes graves et elle analyse les rapports d'enquête sur les accidents en vue d'en tirer des enseignements et de dégager une valeur ajoutée au niveau de l'UE; elle est invitée, à cet égard, à assister les États membres durant les enquêtes sur les accidents qui intéressent des installations maritimes (côtières ou en mer), notamment les accidents touchant les plateformes pétrolières ou gazières; de même, les États membres sont invités à faire preuve avec l'Agence d'une collaboration entière et diligente;
