IN-CONTEXT TRANSLATIONS

3. Recognises the two comments made by the Court of Auditors which focus on the physical inventory and on the budgetary management; is at the same time also aware of the Agency's reply; points out that the carry-overs derive partly from the multi-annual nature, of IT development projects, partly from translations not delivered by year-end and the start of new biocides and PIC activities in the second half of the year; and welcomes therefore the agency's attempts to maximise the synergies between its tasks by making the best possible use of IT tools; reminds however the Agency to respect the annuality principle of the budget as close as possible; insists that the Agency completes as soon as possible the asset inventory exercise and to enforce the asset inventory management with the new version for ABAC assets; recognises at the same time that some shortfalls are legacy driven and arise from the set-up stage of the Agency when laptops and computers were provided through Commission framework contracts and have been used by Commission staff seconded to the Agency at that time; would like to mention that according to the Agency the untraced laptops from the early days have an overall residual value of EUR 5000;
3. prend acte des deux commentaires formulés par la Cour des comptes, qui concernent les stocks physiques et la gestion budgétaire; est également informé de la réponse de l'Agence; indique que les reports s'expliquent à la fois par la nature pluriannuelle des projets de développement informatique, par les traductions qui n'ont pas été livrées avant la fin de l'année et par le lancement de nouvelles activités relatives aux biocides et au consentement préalable en connaissance de cause au second semestre; salue par conséquent les efforts de l'Agence pour maximiser les synergies entre ses activités en tirant profit au mieux des outils informatiques; rappelle toutefois à l'Agence de respecter aussi fidèlement que possible le principe de l'annualité budgétaire; exige que l'Agence termine dès que possible l'inventaire des biens et mette en place une gestion des stocks basée sur la nouvelle version du système ABAC Assets; reconnaît également que l'absence du matériel manquant s'explique pas le fait que, dans la phase de création de l'Agence, les ordinateurs portables et de bureau étaient fournis via des contrats-cadre avec la Commission et étaient utilisés par le personnel de la Commission alors affecté à l'Agence; tient à préciser que, selon l'Agence, les tout premiers ordinateurs portables qui demeurent introuvables auraient une valeur résiduelle totale de 5 000 EUR;

4. Failure by the institution, body, office or agency to reply within the prescribed time limit shall be considered as a definitive negative reply and shall entitle the applicant to institute court proceedings against the institution, body, office or agency and/or make a complaint to the European Ombudsman, under the relevant provisions of the EC Treaty Treaties .

L'absence de réponse de l'institution, de l'organe ou de l'organisme dans le délai requis est considérée comme une réponse négative définitive , et habilite le demandeur à former un recours juridictionnel contre l'institution, l'organe ou l'organisme et/ou à présenter une plainte au médiateur européen, au titre des dispositions pertinentes du traité CE des traités .

Regrets that the Agency's rate of vacant posts is so high (24 %); takes note of the Agency's reply stating that it has difficulties recruiting and retaining staff because of the strong competition with other international organisations in the Hague and that it prepared a recruitment plan to improve the situation; welcomes the information given by the Agency that the vacancy rate was reduced in 2010 to 12 %; points out that this rate is still high and calls on the Agency to continue its efforts to further improve the situation; calls for the recruitment plan mentioned in the Agency's replies to be followed up in 2011;
3. déplore que le taux d'emplois vacants reste aussi élevé (24 %); prend acte de la réponse de l'agence indiquant qu'elle éprouve des difficultés à recruter et à conserver du personnel, en raison de la forte concurrence exercée par d'autres organisations internationales présentes à La Haye, et annonçant qu'elle a préparé un plan de recrutement pour améliorer la situation; se félicite de l'information donnée par l'agence précisant que le taux d'emplois vacants a été ramené à 12 % en 2010; souligne que ce taux reste élevé et invite l'agence à poursuivre ses efforts pour améliorer encore la situation; demande que le plan de recrutement mentionné dans les réponses de l'agence soit poursuivi en 2011;

Considers it a matter for concern that the Court of Auditors has again noted a high number of budget transfers in 2008 (52 in 2008 and 32 in 2007); notes the Agency's reply mentioning that the transfers for the purpose of administrative expenditure were limited to the period 2008-2009 because of the Agency's move to its final offices; is concerned, in particular, that more than EUR 2 000 000 of appropriations for personnel expenditure was transferred to administrative expenditure budget lines between June and November 2008, which made it possible to increase the amount of appropriations carried forward to 2009 and reduce the amount to be repaid to the Commission; notes, nevertheless, the reply by the Agency, which undertakes to continue its effort to improve its planning and monitoring and consequently to reduce the number of budgetary modifications;
5. juge préoccupant que la Cour ait à nouveau relevé un nombre élevé de virements budgétaires en 2008 (52 en 2008 et 32 en 2007); prend note de la réponse de l'Agence mentionnant que les virements en vue des dépenses administratives sont limités à la période 2008/2009 du fait du déménagement de l'Agence dans ses bureaux définitifs; s’inquiète, en particulier, du fait qu’entre juin et novembre 2008, plus de 2 000 000 EUR correspondant à des crédits destinés aux dépenses de personnel ont été virés sur les lignes budgétaires consacrées aux dépenses administratives, ce qui a permis d'augmenter les crédits reportés à l’exercice 2009 et de réduire le montant à rembourser à la Commission; prend acte, néanmoins, de la réponse de l'Agence qui s’engage à poursuivre ses efforts en vue d'améliorer sa planification et son suivi et donc de réduire le nombre de modifications budgétaires;
