Now Know You that We, by and with the advice of Our Privy Council for Canada, do by this Our Proclamation declare and direct that the said Agreement of Social Security between Canada and Italy, signed at Toronto on November 17, 1977 by the Right Honourable Pierre Elliott Trudeau, Prime Minister of Canada and the Honourable Guilio Andreotti, President of the Council of the Ministers of the Republic of Italy, a copy of which is attached hereto, which has been approved and declared to be in force by Order in Council P.C. 1978-3393 of November 7, 1978Footnote is in force effective upon, from and after the 20th day of December, 1978.

Since this Directive is without prejudice to provisions included in bilateral agreements, the social security rights enjoyed by third country national intra-corporate transferees on the basis of a bilateral agreement concluded between the Member State to which the person has been admitted and his or her country of origin could be strengthened compared to the social security rights which would be granted to the transferee under national law.
La présente directive ne portant pas atteinte aux dispositions figurant dans des accords bilatéraux, les droits conférés en matière de sécurité sociale aux ressortissants de pays tiers faisant l'objet d'un détachement intragroupe, en application d'un accord bilatéral conclu entre l'État membre dans lequel la personne détachée a été admise et son pays d'origine, pourraient être renforcés par rapport aux droits qui seraient accordés en matière de sécurité sociale à cette personne en vertu du droit national.

70. Welcomes, in this context, the Ibero-American Convention on Social Security, and proposes providing a possibility for further Member States to join this Convention, alongside Portugal and Spain, as a platform for European coordination; stresses that while bilateral agreements between EU Member States and third countries may provide for better social security protection, they make it difficult for third-country nationals moving between countries in the EU to be aware of their social security rights; welcomes, therefore, the Commission’s proposal for establishing an EU mechanism for the exchange of best practice and information on social security coordination, and proposes that the existing bilateral national agreements be collected, processed and made available in a transparent manner by the Commission; calls on the Commission to provide guidance for Member States entering into any bilateral agreement, so that to ensure more uniform application across the EU, on a basis of respect for both the EU Social Security Coordination and the ILO Social Security Conventions;
70. se félicite, dans ce contexte, de la convention ibéro-américaine de sécurité sociale, et suggère de créer la possibilité pour d'autres États membres d'adhérer à cet accord, aux côtés du Portugal et de l'Espagne, qui constituerait alors une plateforme de coordination européenne; souligne que, s'il est vrai que les accords bilatéraux entre les États membres de l'Union européenne et les pays tiers sont susceptibles d'assurer une meilleure protection sociale, ces accords font qu'il est plus difficile, pour les ressortissants de pays tiers passant d'un État membre de l'Union à un autre, de connaître leurs droits en matière de sécurité sociale; se félicite, par conséquent, de la proposition de la Commission de créer un mécanisme européen d'échange de bonnes pratiques et d'informations sur le thème de la coordination des systèmes de sécurité sociale, et propose que les accords bilatéraux nationaux existants soient rassemblés, traités et mis à disposition de manière transparente par la Commission; invite la Commission à prévoir un dispositif d'orientation pour les États membres qui concluent des accords bilatéraux afin d'assurer une mise en œuvre plus uniforme à travers l'Union européenne, fondée sur le respect de la coordination européenne en matière de sécurité sociale et des conventions de l'OIT relatives à la sécurité sociale;

Article 39(1)(b) and (c) of the Agreement on Social Security of 27 July 2001 (maintenance of the convention concluded between the former Czechoslovak Republic and the former German Democratic Republic for persons who already received a pension before 1996; reckoning of periods of insurance completed in one of the contracting states for persons who already received a pension for these periods on 1 September 2002 from the other contracting state, while residing in its territory).
