During the initial transitional period of seven years, starting from the date of the entry into force of this Agreement, the contribution by each Contracting Member State having ratified or acceded to the Agreement before the entry into force thereof shall be calculated on the basis of the number of European patents having effect in the territory of that State on the date of entry into force of this Agreement and the number of European patents with respect to which actions for infringement or for revocation have been brought before the national courts of that State in the three years preceding entry into force of this Agreement.

He has called upon the Commission to provide a comprehensive annual report on the implementation of the Agreement - together with the Protocol and the Annexes, which form an integral part thereof - in order to enable Parliament to assess more effectively and with greater transparency whether or not the various objectives stated in the Agreement have been achieved, whether or not the Agreement is fully operational, whether or not it acts in the interests of the parties involved and whether or not it is cost-effective for the Community and its fisheries sector. This will afford the sector greater legal security, including monitoring of the application of the exclusivity clause laid down in the Agreement (Article 6) in order to ensure that other parties are not offered (by means of private agreements) opportunities to fish for high-commercial-value species which are withheld from the Community under the public Agreement on the pretext that resources have to be conserved.

Article 300 of the Treaty establishing the European Community specifies four instances in which the conclusion of an international agreement requires assent on the part of the European Parliament. The first is where the agreement is an association agreement within the meaning of Article 310 of the Treaty establishing the European Community; the second, agreements establishing a specific institutional framework by organising cooperation procedures; the third, agreements having important budgetary implications for the Community, and the fourth, agreements entailing amendment of an act adopted under the procedure referred to in Articles 251 or 252 of the Treaty establishing the European Community.

3. If, on 1 January 2006, the requirements for entry into force under paragraph 1 or paragraph 2 of this Article have not been met, the depositary shall invite those governments which have signed this Agreement definitively or have ratified, accepted or approved it, or have notified that they will apply this Agreement provisionally, to decide whether to bring this Agreement into force definitively or provisionally among themselves, in whole or in part, on such date as they may determine.
3. Consequently it has no possibility of directly influencing its content and therefore at this stage we can only reject or accept the agreement as a whole. Having regard to the positive effect the agreement will have in the context of the liberalisation of the market and the harmonisation of fiscal and social provisions, your rapporteur recommends that the agreement be approved.

I have rarely witnessed a budgetary procedure like this in which, until this positive statement allowing the agreement to be concluded, we were still faced with two lists of possible votes. One list would have been made in agreement with the Council and the other would have been established without agreement with the Council.

(19) Whereas existing international co-production agreements must be interpreted in the light of the economic purpose and scope envisaged by the parties upon signature; whereas in the past international co-production agreements have often not expressly and specifically addressed communication to the public by satellite within the meaning of this Directive a particular form of exploitation; whereas the underlying philosophy of many existing international co-production agreements is that the rights in the co-production are exercised separately and independently by each co-producer, by dividing the exploitation rights between them along territorial lines; whereas, as a general rule, in the situation where a communication to the public by satellite authorized by one co-producer would prejudice the value of the exploitation rights of another co-producer, the interpretation of such an existing agreement would normally suggest that the latter co-producer would have to give his consent to the authorization, by the former co-producer, of the communication to the public by satellite; whereas the language exclusivity of the latter co-producer will be prejudiced where the language version or versions of the communication to the public, including where the version is dubbed or subtitled, coincide(s) with the language or the languages widely understood in the territory allotted by the agreement to the latter co-producer; whereas the notion of exclusivity should be understood in a wider sense where the communication to the public by satellite concerns a work which consists merely of images and contains no dialogue or subtitles; whereas a clear rule is necessary in cases where the international co-production agreement does not expressly regulate the division of rights in the specific case of communication to the public by satellite within the meaning of this Directive;

IF THE REQUIREMENTS FOR DEFINITIVE ENTRY INTO FORCE OF THIS AGREEMENT UNDER PARAGRAPH 1 OF THIS ARTICLE HAVE NOT BEEN MET WITHIN 18 CALENDAR MONTHS OF THE AGREEMENT'S PROVISIONAL ENTRY INTO FORCE UNDER PARAGRAPH 2 OF THIS ARTICLE , THE SECRETARY-GENERAL OF THE UNITED NATIONS SHALL , AT THE EARLIEST TIME HE CONSIDERS PRACTICABLE , BUT BEFORE THE END OF THE 18-MONTH PERIOD MENTIONED ABOVE , CONVENE THOSE GOVERNMENTS WHICH HAVE DEPOSITED INSTRUMENTS OF RATIFICATION , ACCEPTANCE , APPROVAL OR ACCESSION , OR HAVE NOTIFIED HIM THAT THEY WILL APPLY THIS AGREEMENT PROVISIONALLY , AND ALL OTHERS WHICH PARTICIPATED IN THE UNITED NATIONS CONFERENCE ON NATURAL RUBBER , 1978 , TO MEET TO REVIEW THE FUTURE OF THIS AGREEMENT .
