IN-CONTEXT TRANSLATIONS

1. The provisions of the Dublin II Regulation which is annexed to this Agreement and forms part thereof, together with its implementing measures adopted pursuant to Article 27(2) of the Dublin II Regulation and — in respect of implementing measures adopted after the entry into force of this Agreement — implemented by Denmark as referred to in Article 4 of this Agreement, shall under international law apply to the relations between the Community and Denmark.

The provisions of the Eurodac Regulation which is annexed to this Agreement and forms part thereof, together with its implementing measures adopted pursuant to Article 22 or 23(2) of the Eurodac Regulation and — in respect of implementing measures adopted after the entry into force of this Agreement — implemented by Denmark as referred to in Article 4 of this Agreement, shall under international law apply to the relations between the Community and Denmark.
2. 2. Denmark will abstain from entering into international agreements which may affect or alter the scope of the Regulations as annexed to this Agreement concerning the determination of responsibility for examining an asylum application or measures concerning the comparison of fingerprints of third country nationals covered by the Eurodac Regulation unless it is done with the agreement of the Community and satisfactory arrangements have been made with regard to the relationship between this Agreement and the international agreement in question.

Le Danemark s’engage à ne pas conclure d’accords internationaux susceptibles d’altérer ou de modifier la portée des règlements tels qu’annexés au présent accord concernant la détermination de l’État membre responsable de l’examen d’une demande d’asile ou les mesures relatives à la comparaison des empreintes digitales de ressortissants de pays tiers couvertes par le «règlement Eurodac» à moins d’agir avec l’accord de la Communauté et que des modalités satisfaisantes soient prévues s’agissant des rapports entre le présent accord et l’accord international en question.

The provisions of the Brussels I Regulation, which is annexed to this Agreement and forms part thereof, together with its implementing measures adopted pursuant to Article 74(2) of the Regulation and, in respect of implementing measures adopted after the entry into force of this Agreement, implemented by Denmark as referred to in Article 4 of this Agreement, and the measures adopted pursuant to Article 74(1) of the Regulation, shall under international law apply to the relations between the Community and Denmark.

This procedure would apply where the Member States had already been authorised to conclude, in the interest of the Community, the international agreement which Denmark requests becoming a party to, or where the Community had already concluded it itself.

We are therefore undertaking a technical study into the possibility of implementing the Eurodac regulation and the future Dublin regulation, on the basis of a parallel agreement with Denmark, which will be in accordance with international public law. This agreement will not be based on the Schengen Agreement, but based directly on Title IV and on the possibility of implementing a parallel agreement under international public law.
