IN-CONTEXT TRANSLATIONS

This Regulation shall be without prejudice to Union rules on local border traffic and to existing bilateral agreements on local border traffic.

9. Points out that the Lisbon Treaty, which came into force on 1 December 2009, incorporates an acknowledgement of the right to regional and local self-government into European Union primary law for the first time (Article 4(2) of the Treaty on European Union); emphasises that in several judgments the CJEU has invoked the right to local self-government and made it clear that the ‘possibility for public authorities to use their own resources to perform the public-interest tasks conferred on them may be exercised in cooperation with other public authorities’ (judgment in Case C-324/07); draws attention, further, to the CJEU Grand Chamber judgment of 9 June 2009 in Case C-480/06, which found, further, that Community law does not require public authorities to use any particular legal form in order to carry out their public service tasks on a joint basis; accordingly, regards public-public partnerships, such as cooperation agreements between local authorities and forms of national cooperation, as falling outside the scope of the public procurement directives, provided that the following criteria are all met:

This Regulation shall be without prejudice to Community rules on local border traffic and to existing bilateral agreements on local border traffic.

2. Before concluding or amending any agreement on local border traffic with neighbouring third countries, Member States shall consult the Commission as to the compatibility of the agreement with this Regulation .
2. Avant de conclure ou de modifier tout accord en matière de petit trafic frontalier avec des pays tiers voisins, les États membres consultent la Commission afin d'en vérifier la compatibilité avec le présent règlement.

3. Where the Community or the Member State concerned has not concluded a general readmission agreement with a third country, the bilateral agreements on local border traffic with that third country shall provide for the readmission of persons found to be abusing the regime established by this Regulation to be facilitated.

Lorsque la Communauté ou les États membres concernés n'ont pas conclu un accord général de réadmission avec un pays tiers, les accords bilatéraux en matière de petit trafic frontalier conclus avec ce pays tiers doivent comporter des dispositions visant à faciliter la réadmission des personnes ayant fait une utilisation abusive du régime établi par le présent règlement.

3. Where the Community or the Member State concerned has not concluded a general readmission agreement with a third country, the bilateral agreements on local border traffic with that third country shall include provisions to facilitate the readmission of persons found to be misusing the regime set out by this Regulation.

3. Paragraph 2 shall not apply to agreements on local border traffic, for which the provisions of Article 13 of [Regulation No . this Regulation] shall apply.
