Stresses that the protection of geographical indications in bilateral agricultural trade will be a key issue in which significant progress is possible if both parties approach the matter in a constructive spirit of compromise; and considers protection of geographical indication as a key component that is directly related to an ambitious outcome regarding agricultural market access; supports the complete cancelation of export refunds in EU-US agricultural trade;

Where farmers are found not to have complied on their holding, at any time during three years from payment of the grubbing-up premium, with the statutory management requirements and the good agricultural and environmental condition referred to in Articles 3 to 7 of Regulation (EC) No 1782/2003, the amount of the payment shall, where non-compliance is the result of an action or omission directly imputable to the farmer, be reduced or cancelled, partially or wholly depending on the severity, extent, permanence and repetition of the non-compliance, and the farmer shall, where applicable, be ordered to reimburse it in accordance with the conditions set out in those provisions.
Lorsqu’il a été constaté qu’un agriculteur n’a pas respecté sur son exploitation, au cours des trois années qui ont suivi le paiement de la prime à l’arrachage, les exigences réglementaires en matière de gestion et les bonnes conditions agricoles et environnementales visées aux articles 3 à 7 du règlement (CE) no 1782/2003, le montant du paiement, lorsque le manquement résulte d’un acte ou d’une omission directement imputable à l’agriculteur, est réduit ou annulé, totalement ou partiellement selon la gravité, l’étendue, la persistance et la répétition du manquement et, le cas échéant, il est demandé à l’agriculteur de procéder à son remboursement conformément aux conditions établies dans lesdites dispositions.

Where the statutory management requirements or good agricultural and environmental conditions are not complied with at any time in a given calendar year (hereinafter “the calendar year concerned”), and the non-compliance in question is the result of an act or omission directly attributable to the farmer who submitted the aid application in the calendar year concerned, the total amount of direct payments to be granted, after application of Articles 10 and 11 to that farmer, shall be reduced or cancelled in accordance with the detailed rules laid down under Article 7.

Where the Commission, in accordance with the detailed rules referred to in Article 19(f), takes the view that compliance with the conditions of the specification for an agricultural product or foodstuff covered by a traditional speciality guaranteed is no longer ensured, it shall initiate the procedure referred to in Article 18(2) for the cancellation of the registration, which shall be published in the Official Journal of the European Union.

There should be procedures to permit amendment of specifications on request of groups having a legitimate interest, after registration, in the light of technological progress and cancellation of the geographical indication or designation of origin for an agricultural product or foodstuff, in particular if that product or foodstuff ceases to conform to the specification on the basis of which the geographical indication or designation of origin was granted.
Il convient de disposer de procédures permettant, après enregistrement, l'adaptation du cahier des charges à la demande de groupes ayant des intérêts légitimes, notamment pour tenir compte de l'évolution des connaissances technologiques, et l'annulation de l'indication géographique ou de l'appellation d'origine d'un produit agricole ou d'une denrée alimentaire, notamment lorsque ce produit ou cette denrée n'est plus conforme au cahier des charges pour lequel il ou elle avait bénéficié de l'indication géographique ou de l'appellation d'origine.
