The logistical and commercial assistance provided by the Post Office to its subsidiary SFMI-Chronopost, the other financial transactions between those two companies, the relationship between SFMI-Chronopost and Radio France, the customs arrangements applicable to the Post Office and SFMI-Chronopost, the system of payroll tax and stamp duty applicable to the Post Office and its (*) investment in the dispatching platforms do not constitute State aid to SFMI-Chronopost.
L'assistance logistique et commerciale fournie par La Poste à sa filiale SFMI-Chronopost, les autres transactions financières entre ces deux sociétés, la relation entre SFMI-Chronopost et Radio France, le régime douanier applicable à La Poste et à SFMI-Chronopost, le système de taxe sur les salaires et de droit de timbre applicables à La Poste et son investissement de (*) dans des plates-formes de messagerie ne constituent pas des aides d'État en faveur de SFMI-Chronopost.

On 21 December 1990, the Syndicat Français de l'Express International ('SFEI`), a consortium of companies providing express delivery services in competition with SFMI-Chronopost, lodged a complaint with the Commission on the grounds that the logistical and commercial assistance provided by the post office to SFMI-Chronopost involved State aid under Articles 92 and 93 of the EC Treaty.

These include the use by SFMI-Chronopost of the Post Office's trade image, and in particular its vehicles as an advertising medium, its privileged access to Radio France's broadcasting programmes, some customs and tax privileges conceded both to SFMI-Chronopost and to the Post Office, and the Post Office's investment in dispatching platforms.

Finally, SFEI claims that SFMI-Chronopost benefits from an investment of FRF 1,2 billion made in 1995 by the Post Office to construct a number of dispatching platforms.

In addition to this direct remuneration, SFMI-Chronopost pays a fee whose amount depends on SFMI-Chronopost's turnover and its annual increase (*).

As it does not have sufficient information to rule out the inclusion of state aid in the measures taken in the express delivery sector in France since 1986 with regard to SFMI and Chronopost, both controlled by the French Post Office, the Commission has decided to resume examination of the case.
Ne disposant pas d'informations suffisantes pour exclure que les dispositions adoptées en France depuis 1986 dans le secteur du courrier express à l'égard des sociétés SFMI et Chronopost, contrôlées par la Poste, puissent impliquer des aides d'Etat, la Commission a décidé de poursuivre l'examen du dossier.

It intends in particular to obtain all the accounting data and other information needed to check that the relations between the French State and the entities operating on behalf of the Post Office in the express delivery sector do not include the granting of aid to SFMI and Chronopost which is incompatible with the common market.
