(2) Where a purchaser of transportation by air from an air carrier has incorrectly stated or certified that the transportation by air was intended for a use rendering the transportation exempt from tax under Part II, the air carrier is entitled to recover from the purchaser the taxes paid by the air carrier under that Part in respect of that transportation by air.

(4) Where a person who has requested from an air carrier a service referred to in subsection (1) or (2) must travel on a flight of another air carrier because of a flight cancellation or the substitution by the original air carrier of an aircraft that has fewer than 30 passenger seats, the original air carrier shall cooperate as much as is possible with the other air carrier in providing the requested service.

(2) Where the air carrier is named as an additional insured under the policy of the licensee referred to in subsection (1), there must be a written agreement between the air carrier and the licensee to the effect that, for all charters or series of charters that are subcontracted, the licensee will hold the air carrier harmless from, and indemnify the air carrier for, all passenger and third party liabilities while passengers or cargo transported under a contract with the air carrier are under the control of the licensee.

1. Every Member State shall ensure that air carriers providing services from their territory implement and maintain an air carrier security programme appropriate to meet the requirements of national civil aviation security programmes. That programme shall describe the methods and procedures which are to be followed by the air carrier in order to comply both with this Regulation and with the national civil aviation security programme of the Member State from which it provides services.

2. An air carrier and the managing body of an airport may agree that, for the passengers whom that air carrier transports to and from the airport, the managing body shall provide assistance of a higher standard than the standards mentioned in paragraph 1 or provide services additional to those specified in Annex I. For the purpose of funding either of these, the managing body may levy a charge on the air carrier additional to that mentioned in Article 8(3) , which shall be transparent, cost related and established after consultation of the air carrier concerned.

the term "Community industry" shall be interpreted as referring to the Community air carriers supplying like air services as a whole on routes to and from the Community or within it, or those of them whose collective provision of air services represents a substantial part of the total Community supply of those services; When some Community carriers are related, for example by means of an alliance agreement, to the allegedly subsidized non-Community air carrier, the term 'Community industry' may be interpreted as referring to the rest of the Community air carriers.
