Ltd., Fishery Products International Ltd., Great Harbour Deep Seafoods Ltd., or any company formed by the amalgamation of two or more of the aforesaid fishery enterprises, the powers given to the Minister of Fisheries and Oceans pursuant to subsection 6(1) of the Act.

(a) iodinated contrast media products exported by or on behalf of Searle Ltd. and imported by Nycomed Amersham Canada Ltd. that are identical to those products exported by or on behalf of Searle Ltd. and imported by Nycomed Amersham Canada Ltd. during that portion of the period of investigation beginning on January 1, 1999 and ending on June 30, 1999;

(2) The undertakings provided by 853350 Alberta Ltd. and Air Canada to the Minister of Transport in the letter referred to in subsection (1) are deemed to be terms and conditions specified in an approval by the Governor in Council under subsection 53.2(7) of the Canada Transportation Act that relate to national transportation concerns, and the undertakings provided by 853350 Alberta Ltd. and Air Canada to the Commissioner of Competition that are set out in Annex A to a letter from the Commissioner dated December 21, 1999 in respect of the acquisition referred to in that subsection are deemed to be terms and conditions of an approval under subsection 53.2(7) of the Canada Transportation Act that relate to potential prevention or lessening of competition.

The amount of anti-dumping duties referred to in section 2 of this Order, in respect of iodinated contrast media products exported by or on behalf of Searle Ltd. and imported by Nycomed Amersham Canada Ltd., or exported by or on behalf of Bristol-Myers Squibb Company and imported by Bracco Diagnostics Canada Inc., other than those products to which paragraph 2(a) or (b) of this Order applies, shall, in respect of each iodinated contrast media product, be the greater of

– having regard to the Framework Agreement for commercial and economic cooperation between the European Communities and Canada and other subsequent bilateral agreements with Canada, in particular the Agreement on customs cooperation and mutual assistance in customs matters , the Agreement on sanitary measures to protect public and animal health in respect of trade in live animals and animal products , the Agreement on trade in wines and spirit drinks , the Agreement on civil aviation safety and the Agreement on air transport ,
– vu l'accord-cadre de coopération commerciale et économique entre les Communautés européennes et le Canada et d'autres accords ultérieurs avec le Canada, notamment l'accord sur la coopération douanière et l'assistance mutuelle en matière douanière , l'accord relatif aux mesures sanitaires de protection de la santé publique et animale applicables au commerce d'animaux vivants et de produits animaux , l'accord relatif au commerce des vins et des boissons spiritueuses , l'accord sur la sécurité de l'aviation civile et l'accord sur le transport aérien ,
