In the light of the evidence set out above, the Tribunal finds that the applicant has failed to prove to the requisite legal standard that the fact that the candidates who were examined last had more time to prepare for the case study and some candidates could have obtained information from other candidates about the content of the version of the subject on which they were going to be examined, was capable of giving the candidates who sat the case study last a genuine advantage over the other candidates.

In the present case, it should be noted that the Commission stated in its response to the measures of organisation of procedure and at the hearing, without being contradicted by the applicant, that although the selection board did not remain stable throughout the tests, at the very least, it met at the beginning when it decided on the way the tests were to take place, then every two or three days, on each occasion on which the marks awarded to the candidates were brought together in order to form an assessment of the competencies of the candidates who had been examined over that period and, lastly, when it reviewed the consistency of the assessments of the candidates at the end of all the tests.
