With a view to reinforcing the partnership between the European Union and Latin America, the European Commission has approved today an ambitious co-operation programme « ALliance for the Information Society » (@LIS) with Latin America. It aims at establishing dialogue and co-operation on policy and regulatory frameworks in key areas for the development of a widespread information society, such as telecommunications, e-commerce and standardisation, and at boosting interconnections between research networks and communities in both regions.
Soucieuse de renforcer le partenariat entre l'Union européenne et l'Amérique latine, la Commission européenne a approuvé ce jour un programme ambitieux de coopération intitulé « Alliance pour la société de l'information » (@LIS), qui vise à établir un dialogue et une coopération sur la définition de cadres de politique et de réglementation se rapportant à des domaines essentiels à une large diffusion de la société de l'information tels que les télécommunications, le commerce électronique et la normalisation, ainsi qu'à promouvoir les synergies entre réseaux et communautés de recherche des deux régions.

(18) Information society services span a wide range of economic activities which take place on-line; these activities can, in particular, consist of selling goods on-line; activities such as the delivery of goods as such or the provision of services off-line are not covered; information society services are not solely restricted to services giving rise to on-line contracting but also, in so far as they represent an economic activity, extend to services which are not remunerated by those who receive them, such as those offering on-line information or commercial communications, or those providing tools allowing for search, access and retrieval of data; information society services also include services consisting of the transmission of information via a communication network, in providing access to a communication network or in hosting information provided by a recipient of the service; television broadcasting within the meaning of Directive EEC/89/552 and radio broadcasting are not information society services because they are not provided at individual request; by contrast, services which are transmitted point to point, such as video-on-demand or the provision of commercial communications by electronic mail are information society services; the use of electronic mail or equivalent individual communications for instance by natural persons acting outside their trade, business or profession including their use for the conclusion of contracts between such persons is not an information society service; the contractual relationship between an employee and his employer is not an information society service; activities which by their very nature cannot be carried out at a distance and by electronic means, such as the statutory auditing of company accounts or medical advice requiring the physical examination of a patient are not information society services.
(18) Les services de la société de l'information englobent un large éventail d'activités économiques qui ont lieu en ligne. (63) The adoption of this Directive will not prevent the Member States from taking into account the various social, societal and cultural implications which are inherent in the advent of the information society; in particular it should not hinder measures which Member States might adopt in conformity with Community law to achieve social, cultural and democratic goals taking into account their linguistic diversity, national and regional specificities as well as their cultural heritage, and to ensure and maintain public access to the widest possible range of information society services; in any case, the development of the information society is to ensure that Community citizens can have access to the cultural European heritage provided in the digital environment.
(63) L'adoption de la présente directive ne saurait empêcher les États membres de prendre en compte les différentes implications sociales, sociétales et culturelles inhérentes à l'avènement de la société de l'information. En particulier, elle ne devrait pas porter atteinte aux mesures destinées à atteindre des objectifs sociaux, culturels et démocratiques que les États membres pourraient adopter, conformément au droit communautaire, en tenant compte de leur diversité linguistique, des spécificités nationales et régionales ainsi que de leurs patrimoines culturels, et à assurer et à maintenir l'accès du public à un éventail le plus large possible de services de la société de l'information. Le développement de la société de l'information doit assurer, en tout état de cause, l'accès des citoyens de la Communauté au patrimoine culturel européen fourni dans un environnement numérique.

(42) The exemptions from liability established in this Directive cover only cases where the activity of the information society service provider is limited to the technical process of operating and giving access to a communication network over which information made available by third parties is transmitted or temporarily stored, for the sole purpose of making the transmission more efficient; this activity is of a mere technical, automatic and passive nature, which implies that the information society service provider has neither knowledge of nor control over the information which is transmitted or stored.
(42) Les dérogations en matière de responsabilité prévues par la présente directive ne couvrent que les cas où l'activité du prestataire de services dans le cadre de la société de l'information est limitée au processus technique d'exploitation et de fourniture d'un accès à un réseau de communication sur lequel les informations fournies par des tiers sont transmises ou stockées temporairement, dans le seul but d'améliorer l'efficacité de la transmission. Cette activité revêt un caractère purement technique, automatique et passif, qui implique que le prestataire de services de la société de l'information n'a pas la connaissance ni le contrôle des informations transmises ou stockées.

This meeting, which was attended by representatives of Governments and regulatory Authorities, private sector and the civil society, pursued the bi-regional dialogue in this field and formally launched the new @LIS (Alliance for the Information Society) Co-operation Programme with Latin America, as a follow up of the Rio de Janeiro Summit.
Cette réunion, à laquelle assistaient des représentants des gouvernements et des autorités réglementaires, du secteur privé et de la société civile, a permis de poursuivre le dialogue entre les deux régions dans ce domaine et de lancer officiellement le nouveau programme de coopération avec l'Amérique latine baptisé @LIS (Alliance for the Information Society), en guise de suivi du sommet de Rio de Janeiro.
