Her Excellency the Governor General in Council, on the recommendation of the Prime Minister, pursuant to section 7 of the Atlantic Fisheries Restructuring Act, is pleased hereby to authorize the Minister of Regional Industrial Expansion to exercise in respect of 125459 Canada Ltd., The Lake Group Ltd., John Penny and Sons Ltd., Caribou Fisheries Inc., Caribou Food Industries Inc., Fishery Products Ltd., Fishery Products (St. Anthony) Ltd., Fishery Products (Harbour Breton) Ltd., St. Anthony Fisheries Ltd., Fishery Products Inc., North Atlantic Fisheries Ltd., T.J. Hardy Co. Ltd., Fishery Products International Ltd., Great Harbour Deep Seafoods Ltd., or any company formed by the amalgamation of two or more of the aforesaid fishery enterprises, the powers given to the Minister of Fisheries and Oceans pursuant to subsection 6(1) of the Act.

(2) Where, in the opinion of the Board, it is desirable that a single tariff be established in Canada in respect of the pipeline, the Board may, on application of Foothills Pipe Lines (Yukon) Ltd. or on its own motion, by order, require Foothills Pipe Lines (Yukon) Ltd. to file such a tariff and, where the Board does so, Foothills Pipe Lines (Yukon) Ltd. is deemed to be a company for the purposes of this Part and Part IV of the National Energy Board Act and every other company is relieved from any obligation to file a tariff until the Board rescinds that order.

(2) The undertakings provided by 853350 Alberta Ltd. and Air Canada to the Minister of Transport in the letter referred to in subsection (1) are deemed to be terms and conditions specified in an approval by the Governor in Council under subsection 53.2(7) of the Canada Transportation Act that relate to national transportation concerns, and the undertakings provided by 853350 Alberta Ltd. and Air Canada to the Commissioner of Competition that are set out in Annex A to a letter from the Commissioner dated December 21, 1999 in respect of the acquisition referred to in that subsection are deemed to be terms and conditions of an approval under subsection 53.2(7) of the Canada Transportation Act that relate to potential prevention or lessening of competition.

Therefore, the Minister of Transport, pursuant to section 73 of the National Transportation Act, 1987Footnote , hereby revokes the Lawrence Bay Airways Ltd. Exemption Order, 1988, made on December 31, 1988Footnote , and makes the annexed Order respecting the exemption of Lawrence Bay Airways Ltd. from the application of subparagraph 72(2)(a)(i) of the National Transportation Act, 1987, in substitution therefor.
