IN-CONTEXT TRANSLATIONS

In order to supplement and amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of the identification of the period of time and of the relevant starting or ending dates of the period of time with regard to the admissibility criteria of applications, adjusting the percentages concerning the indicative distribution of funds among the objectives under direct management, the definition of eligible operations and costs for hygiene, health and safety-related investments and investments concerning working conditions, on board or in individual equipment, the definition of eligible costs of operations to protect and restore marine biodiversity and ecosystems in the framework of sustainable fishing activities, the definition of costs eligible for support with regard to investments in equipment or on board aimed at reducing the emission of pollutants or green-house gases and increasing the energy efficiency of fishing vessels, the definition of the criteria for calculation of the additional costs resulting from the specific handicaps of outermost regions, the definition of the cases of non-compliance by Member States which can trigger interruption of the payment deadline or suspension of payments, the definition of the criteria for establishing the level of financial correction to be applied and the criteria for applying flat rates or extrapolated financial corrections and the definition of the content and construction of the common monitoring and evaluation system.
Afin de compléter et de modifier certains éléments non essentiels du présent règlement, il convient de déléguer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne en ce qui concerne la détermination de la période et de la date de début ou de fin pertinente de la période en rapport avec les critères d’admissibilité des demandes, en ajustant les pourcentages concernant la répartition indicative des fonds entre les objectifs relevant de la gestion directe, la définition des opérations éligibles et les coûts associés aux investissements en matière d’hygiène, de santé et de sécurité concernant les conditions de travail, à bord ou pour les équipements individuels, la définition des coûts éligibles liés aux opérations visant à protéger et à rétablir la biodiversité et les écosystèmes marins dans le cadre d’activités de pêche durables, la définition de coûts éligibles au soutien en ce qui concerne les investissements en matière d’équipements ou à bord visant à réduire l’émission de polluants ou de gaz à effet de serre et à augmenter l’efficacité énergétique des navires de pêche, la définition des critères de calcul des coûts supplémentaires résultant des handicaps spécifiques des régions ultrapériphériques, la définition des cas de manquement par les États membres qui peuvent entraîner l’interruption du délai de paiement ou la suspension des paiements, la définition des critères de détermination du niveau de correction financière à appliquer et des critères relatifs à l’application de corrections financières forfaitaires ou extrapolées, et la définition du contenu et de la construction d’un cadre commun pour le système de suivi et d’évaluation.

3. In addition to the cases referred to in paragraph 2, the Commission may, by means of implementing acts, amend the implementing act referred to in paragraph 1, in accordance with the principles set out in Section 2 of Annex II, where there is a risk that a plant, plant product or other object not listed in that act hosts the respective protected zone quarantine pest, or where, for a plant, plant product or other object listed in that act, that risk no longer exists.
3. Outre les cas visés au paragraphe 2, la Commission peut, au moyen d'actes d'exécution, modifier l'acte d'exécution visé au paragraphe 1, conformément aux principes énoncés à l'annexe II, section 2, dès lors qu'il existe un risque qu'un végétal, produit végétal ou autre objet non répertorié dans ledit acte soit porteur de l'organisme de quarantaine de zone protégée correspondant ou lorsqu'un tel risque a cessé d'exister pour des végétaux, produits végétaux ou autres objets répertoriés dans ledit acte.

(13) In order to achieve the objective of exchange of information between Member States through interoperable means, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of amendments to Annexes I and II of this Regulation in the light of technical progress, in particular, in order to take into account relevant amendments to Directive 1999/37/EC or amendments to other Union acts directly relevant for the updating of Annexes I and II of this Regulation, in respect of the conditions which should be met by undertakings using professional vehicle registration certificates in order to satisfy the requirements of a good reputation and the requisite professional competence, and in respect of the duration of the validity of the professional vehicle registration certificates.
(13) Afin de réaliser l'objectif d'un échange d'informations entre les États membres grâce à des moyens interopérables, le pouvoir d'adopter des actes conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne devrait être délégué à la Commission en vue de l'adoption de modifications aux annexes I et II du présent règlement pour les adapter au progrès technique, afin notamment de tenir compte des modifications pertinentes apportées à la directive 1999/37/CE ou à d'autres actes de l'Union directement applicables en ce qui concerne la mise à jour des annexes I et II du présent règlement, ainsi qu'en vue de la définition des conditions que doivent remplir les entreprises utilisant des certificats d'immatriculation professionnels pour satisfaire aux exigences en matière de bonne réputation et de compétences professionnelles et en vue de la détermination de la durée de validité des certificats d'immatriculation professionnels.

Moreover, it is necessary to keep up-to-date a number of non-essential elements of this Directive, namely the list of international conventions laying down safety requirements for marine equipment contained in Article 2(3) and the references to specific standards contained in Annex III. The power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should therefore be delegated to the Commission in respect of the adoption, on an interim basis, of harmonised technical specifications and testing standards and in order to amend the said lists and references.
Il est en outre nécessaire d'actualiser un certain nombre d'éléments non essentiels de la présente directive, à savoir la liste des conventions internationales établissant des exigences de sécurité applicables aux équipements marins figurant à l'article 2, paragraphe 3, et les références aux normes spécifiques figurant à l'annexe III. Le pouvoir d'adopter des actes visés à l'article 290 du traité sur le fonctionnement de l'Union européenne devrait par conséquent être délégué à la Commission en vue de l'adoption, à titre provisoire, de spécifications techniques et de normes d'essai harmonisées ainsi que de la modification des listes et références précitées.

The amendments in this respect have the objective to integrate in the basic act the main principles that serve to rule/guide the Commission in its acts (delegated acts).

In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union (TFEU) should be delegated to the Commission in respect of: the amendment of Annexes I, II, IV and V to this Regulation in order to adapt them to technical progress or to take account of international regulatory developments in which the Union or the Member States are involved, in the field of clinical trials; the amendment of Annex III in order to improve the information on the safety of medicinal products, to adapt technical requirements to technical progress or to take account of international regulatory developments in the field of safety requirements in clinical trials endorsed by bodies in which the Union or the Member States participate; the specification of the principles and guidelines of good manufacturing practice and the detailed arrangements for inspection for ensuring the quality of investigational medicinal products; the amendment of Annex VI in order to ensure subject safety and the reliability and robustness of data generated in a clinical trial or to take account of technical progress.
Afin de compléter ou de modifier certains éléments non essentiels du présent règlement, il convient de déléguer à la Commission le pouvoir d'adopter des actes délégués conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne (TFUE) pour ce qui concerne: la modification des annexes I, II, IV et V du présent règlement afin de les adapter au progrès technique ou de tenir compte de développements réglementaires internationaux dans le domaine des essais cliniques auxquels l'Union ou les États membres sont associés; la modification de l'annexe III afin d'améliorer les informations sur la sécurité des médicaments, d'adapter les exigences techniques au progrès technique ou de tenir compte des développements réglementaires internationaux dans le domaine des exigences de sécurité applicables aux essais cliniques approuvées par les organismes auxquels l'Union ou les États membres sont associés; la spécification des principes et des lignes directrices de bonnes pratiques de fabrication et les modalités d'inspection pour garantir la qualité des médicaments expérimentaux; la modification de l'annexe VI afin de garantir la sécurité des participants ainsi que la fiabilité et la robustesse des données générées lors d'un essai clinique ou de tenir compte du progrès technique.

The Commission shall be empowered to adopt delegated acts in accordance with Article 89 in respect of amending Annex VI in order to ensure subject safety and the reliability and robustness of data generated in a clinical trial or to take account of technical progress.
La Commission est habilitée à adopter des actes délégués en conformité avec l'article 89 afin de modifier l'annexe VI dans le but de garantir la sécurité du participant ainsi que la fiabilité et la robustesse des données obtenues lors d'un essai clinique ou de tenir compte du progrès technique.

Ladies and gentlemen, either we got it completely wrong and failed with regard to this act, or science and technology have evolved to such an extent that the act already needs amending, which can be done very quickly through the comitology procedure, or there is nothing wrong, in which case we cannot play unnecessarily on people’s fears and on their justified concern for their children’s safety.
Mesdames et Messieurs, soit nous nous sommes complètement fourvoyés et cette législation peut être considérée comme un échec, soit la science et la technologie ont tellement évolué depuis qu’elle doit déjà être amendée, ce qui peut se faire très rapidement via la procédure de comitologie, soit, en fait, tout va bien. 2. The amendment of an act referred to in paragraph 1 shall entail the applicability of the powers of the institutions referred to in that paragraph as set out in the Treaties with respect to the amended act for those Member States to which that amended act shall apply.
2. La modification d'un acte visé au paragraphe 1 entraîne l'application, en ce qui concerne l'acte modifié et à l'égard des États membres auxquels cet acte s'applique, des attributions des institutions visées audit paragraphe telles que prévues par les traités.
