In line with the amendments proposed by the Council in its General approach and agreed by the Commission and after consulting the European Parliament's Legal Service, the rapporteur tables amendments to repeal two additional acts, which have also become obsolete:

4. As the coexistence of two Commission proposals ("first proposal" and "second proposal") to amend the same legislative act has created an unclear legal situation, clarification was requested from the European Parliament Legal Service as to the "direct effect" of Article 15 TFEU and the possibility of considering the Commission proposal ("second proposal") as a sufficient amendment of Regulation 1049/2011 as regards the obligations contained in the Lisbon Treaty.
4. Comme la coexistence de deux propositions de la Commission ("première proposition" et "deuxième proposition") visant à modifier le même acte législatif a créé une situation de flou juridique, il a été demandé au service juridique du Parlement européen de fournir des éclaircissements quant à "l'effet direct" de l'article 15 du traité FUE et à la possibilité de considérer la proposition de la Commission ("deuxième proposition") comme une modification suffisante du règlement 1049/2011 au regard des obligations contenues dans le traité de Lisbonne.

6. After adoption of one of the acts referred to in paragraph 5(d) or final adoption of the act concerned, the General Secretariat shall make available to the public any documents relating to this act which were drawn up before one of such acts and which are not covered by any of the exceptions laid down in Article 4(1), (2) and (3), second subparagraph, of Regulation (EC) No 1049/2001, such as information notes, reports, progress reports and reports on the state of discussions in the Council or in one of its preparatory bodies (outcomes of proceedings), excluding Legal Service opinions and contributions.

In order to assist the Council in its task of ensuring the drafting quality of the legislative acts which it adopts, the Legal Service shall be responsible for checking the drafting quality of proposals and draft acts at the appropriate stage, as well as for bringing drafting suggestions to the attention of the Council and its bodies, pursuant to the Interinstitutional Agreement of 22 December 1998 on common guidelines for the quality of drafting of Community legislation

The Council Legal Service recalls that, pursuant to point 4, second subparagraph of the Interinstitutional Agreement of 28 November 2001, "a new legal act shall not constitute a recast if, with the exception of standardised provisions or wordings, it makes substantive amendments to all the provisions of the earlier act, which it replaces and repeals".
