Article 11(1) of Regulation (EC) No 1069/2009 of the European Parliament and of the Council of 21 October 2009 laying down health rules as regards animal by-products and derived products not intended for human consumption and repealing Regulation (EC) No 1774/2002 (3) prohibits the feeding of terrestrial animals of a given species other than fur animals with processed animal protein derived from the bodies or parts of bodies of animals of the same species, as well as the feeding of farmed fish with processed animal protein derived from the bodies or parts of bodies of farmed fish of the same species.
L’article 11, paragraphe 1, du règlement (CE) no 1069/2009 du Parlement européen et du Conseil du 21 octobre 2009 établissant des règles sanitaires applicables aux sous-produits animaux et produits dérivés non destinés à la consommation humaine et abrogeant le règlement (CE) no 1774/2002 (3) interdit l’alimentation d’animaux terrestres d’une espèce donnée, autres que les animaux à fourrure, au moyen de protéines animales transformées dérivées de corps ou de parties de corps d’animaux de la même espèce, ainsi que l’alimentation des poissons d’élevage au moyen de protéines animales transformées dérivées de corps ou de parties corporelles de poissons d’élevage de la même espèce.

In keeping with the principle of good, consistent lawmaking, the definition of 'products of animal origin' given in point 8.1 of Annex I to Regulation (EC) No 853/2004 should be employed here as well, all the more so because facilities approved under that regulation are exempt from approval under the replacement regulation.

Takes the view that veterinary and customs controls at EU borders should be particularly rigorous with a view to preventing the illegal importation of or trafficking in animals and animal products, given the major risk of spreading disease that such importation and trafficking entail; draws attention, in this connection, to the need for organisational, training and financial assistance to be provided to veterinary services at the EU's external borders, including its maritime borders, in particular in the new Member States, third countries neighbouring the EU, and developing countries; calls, furthermore, on the Commission and the Member States to draw up appropriate communication plans to inform people of the risks associated with the private import of animals and animal products;

The crux of the problem is that usually, when meat from calves is sold, no reference is made either to the type of feed the animals are given or to their age at the time of slaughter, although production practices differ greatly from one Member State to another.

(17) In the veterinary sector, if no medicinal product has been authorised for a given species or a given disorder, the possibility of using other existing products should be made a straightforward matter, but without prejudicing consumer health in the case of medicinal products intended for administration to food-producing animals.

1. Where the checks provided by Directives 90/675/EEC and 91/496/EEC reveal the use of unauthorized products or substances for the treatment of the animals in a given batch - batch within the meaning of Article 2 (2) (e) of Directive 91/496/EEC - or the presence of such products or substances in all or part of a batch originating in the same establishment, the competent authority shall take the following measures in respect of the animals and products involved in such use:
1. Whereas, given the significant risk of the spread of diseases to which animals are exposed, for certain animals and products of animal origin particular requirements should be specified to be imposed when they are placed on the market for the purposes of trade, particularly when intended for regions with a high health status;
