TRADUCTIONS EN CONTEXTE

In order to ensure a smooth transition between the rules on organic origin of plant reproductive material provided for in Article 12(1)(i) of Regulation (EC) No 834/2007 and on animals for breeding purposes provided for in Article 14(1)(a)(ii) of that Regulation and on young stock of aquaculture animals provided for in Article 15(1)(a)(ii) of that Regulation and the exception to production rules that the Commission adopted pursuant to Article 22 of Regulation (EC) No 834/2007, and the new production rules for plants and plant products and livestock and seaweed and aquaculture animals provided for in Articles 10(1) and 11(1), respectively, of this Regulation, the Commission shall be empowered to adopt delegated acts in accordance with Article 36 providing for exceptions where granting exceptions is deemed necessary in order to ensure access to plant reproductive material and live animals for breeding purposes and young stock of aquaculture animals, that may be used in organic production.

(77) In order to ensure a smooth transition between on the one hand the rules on the organic origin of plant reproductive material and on animals for breeding purposes provided for in Regulation (EC) No 834/2007 and the exception to production rules adopted pursuant to Article 22 of that Regulation, and on the other hand the new production rules for plants and plant products and livestock provided for in this Regulation, the power to adopt certain acts should be delegated to the Commission in respect of the granting of exceptions where exceptions are deemed necessary, in order to ensure access to plant reproductive material and live animals for breeding purposes that may be used in organic production.
(77) Afin de garantir une transition harmonieuse entre, d'une part, les règles concernant l'origine biologique du matériel de reproduction des végétaux et des animaux destinés à la reproduction prévues dans le règlement (CE) n° 834/2007 et la dérogation aux règles de production adoptées en vertu de l'article 22 de ce règlement, et, d'autre part, les nouvelles règles de production applicables aux végétaux et produits végétaux et aux animaux d'élevage prévues dans le présent règlement, il convient de déléguer à la Commission le pouvoir d'adopter certains actes en ce qui concerne l'octroi de dérogations, lorsque ces dérogations sont jugées nécessaires, pour garantir l'accès à du matériel de reproduction des végétaux et à des animaux vivants destinés à la reproduction pouvant être utilisés dans la production biologique.

3. This Regulation shall apply without prejudice to related Union legislation in the fields of inter alia safety of the food chain, animal health and welfare, plant health, and plant reproductive material, and in particular to Regulation (EU) No XX/XXX of the European Parliament and of the Council[36] (plant reproductive material) and Regulation (EU) No XX/XXXX of the European Parliament and of the Council[37] (protective measures against pests of plants).
3. For example, transplanting of animal reproductive material into humans, or cloning for the purpose of creating another human being, are practices that must be prohibited.

Finally, the effects conferred by the European patent with unitary effect shall not extend to the use of the patented invention on board vessels, aircrafts or land vehicles of countries other than participating Member States, when such vessels, aircrafts or vehicles temporarily or accidentally enter the waters of participating Member States and to the use by a farmer of protected livestock for farming purposes, on condition that the breeding animals or other animal reproductive material was sold or otherwise commercialised to the farmer by the patent proprietor or with his consent.
