This situation generates duplication. It would also be useful to examine the Working Party's suggestion that the infringement procedure be reformed, given the large number of infringements that are not challenged by the Member States concerned. The infringement could, as happens under the ECSC Treaty, be recorded by a Commission decision, against which an action for annulment could then be brought in the ECJ.
