The various transactions relating to the company Andes Holding BV and the injection of capital of Pta 87 billion made by the company Teneo on behalf of the company Iberia do not amount to State aid within the meaning of Article 92 (1) of the Treaty establishing the European Community or Article 61 (1) of the Agreement establishing the European Economic Area, particularly in view of the Spanish Government's undertakings set out at the end of the ante-penultimate paragraph of point VII above.
Les différentes transactions relatives à la société Andes Holding BV et l'injection de capital de 87 milliards de pesetas espagnoles réalisée par la société Teneo au profit de la compagnie Iberia ne constituent pas des aides d'État au sens de l'article 92 paragraphe 1 du traité instituant la Communauté européenne, et de l'article 61 paragraphe 1 de l'accord instituant l'Espace économique européen, au vu notamment des engagements du gouvernement espagnol énumérés à la fin de l'antépénultième alinéa de la partie VII.
