In order to implement the international agreements providing for the reduction or phasing out of import duties on processed agricultural products on the basis of specific agricultural products used or considered to have been used in the manufacturing of the processed agricultural products, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of the establishment of a list of those agricultural products which are to be considered to have been used in the manufacture of the processed agricultural products, the establishment of the equivalent quantities and the rules for the conversion of other agricultural products to equivalent quantities of the specific agricultural products considered to have been used, the elements necessary for the calculation of the reduced agricultural component and the reduced additional duties and the methods of that calculation, and the negligible amounts for which the reduced agricultural components and the additional duties on sugar and flour are to be fixed at zero.

In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty should be delegated to the Commission in respect of supplementing the list of products set out in Annex I to this Regulation; establishing the restrictions and derogations with regard to the sourcing of feed in the case of a designation of origin; establishing restrictions and derogations with regard to the slaughtering of live animals or with regard to the sourcing of raw materials; laying down rules which limit the information contained in the product specification; establishing the Union symbols; laying down additional transitional rules in order to protect the rights and legitimate interests of producers or stakeholders concerned; laying down further details on the eligibility criteria for the names of traditional specialities guaranteed; laying down detailed rules relating to the criteria for optional quality terms; reserving an additional optional quality term, laying down its conditions of use and amending those conditions; laying down derogations to the use of the term ‘mountain product’ and establishing the methods of production, and other criteria relevant for the application of that optional quality term, in particular, laying down the conditions under which raw materials or feedstuffs are permitted to come from outside the mountain areas; laying down additional rules for determining the generic status of terms in the Union; laying down rules for determining the use of the name of a plant variety or of an animal breed; defining the rules for carrying out the national objection procedure for joint applications concerning more than one national territory; and for complementing the rules of the application process, the opposition process, the amendment application process and the cancellation process in general.

Il convient dès lors, pour des raisons de rationalité et de clarté, de procéder à la codification desdites directives en les regroupant en un texte unique.

(4) In order to achieve the goal of lowering prices in these regions and mitigating the additional costs of their remoteness, insularity and outermost location while maintaining the competitiveness of Community products, aid should be granted for the supply to the islands of products of Community origin. Such aid should take account of the additional cost of transport to Madeira and the Azores and the prices applied to exports to third countries and, in the case of agricultural inputs and products intended for processing, the additional costs of insularity and outermost location.
(4) En vue de réaliser efficacement l'objectif d'abaisser les prix dans ces régions et de pallier les surcoûts d'éloignement, d'insularité et d'ultrapériphéricité et dans le même temps de maintenir la compétitivité des produits communautaires, il convient d'octroyer des aides pour la fourniture de produits communautaires dans les archipels; ces aides tiennent compte des surcoûts d'acheminement vers Madère et les Açores et des prix pratiqués à l'exportation vers les pays tiers, et, lorsqu'il s'agit d'intrants agricoles ou de produits destinés à la transformation, des surcoûts d'insularité et d'ultrapériphéricité.

(2) The particular geographical situation of the French overseas departments (FOD) imposes additional transport costs in supplying essential products, for processing and as agricultural inputs. In addition, objective factors arising as a result of insularity and extreme remoteness impose further constraints on operators and producers in the FOD that severely handicap their activities. This is true particularly in the case of the supply of cereals, which are by and large not produced and cannot be produced on a large scale in the FOD, rendering them dependent on external sources of supply. These handicaps can be alleviated by lowering the price of these essential products. It is therefore appropriate to introduce specific supply arrangements with a view to ensuring supply to the FOD from local production and to mitigating the additional costs of the remoteness, insularity and outermost location of the FOD.
(2) La situation géographique exceptionnelle des DOM, par rapport aux sources d'approvisionnement en produits essentiels à la transformation et en tant qu'intrants agricoles, impose dans ces régions des surcoûts d'acheminement; en outre, des facteurs objectifs liés à l'insularité et à l'ultrapériphéricité imposent aux opérateurs et producteurs des DOM des contraintes supplémentaires qui handicapent lourdement leurs activités; ceci est particulièrement le cas en ce qui concerne l'approvisionnement en céréales dont la production dans les DOM est pour l'essentiel absente et ne peut être envisagée à grande échelle, les rendant ainsi dépendants des sources extérieures d'approvisionnement; ces handicaps peuvent être allégés en abaissant les prix desdits produits essentiels; ainsi, il est approprié, afin de garantir l'approvisionnement des DOM à partir de la production locale et en vue de pallier les surcoûts d'éloignement, d'insularité et d'ultrapériphéricité des DOM, d'instaurer un régime spécifique d'approvisionnement.
