In exceptional cases where the contracting authority or contracting entity receives a tender which proposes an innovative solution with an exceptional level of functional performance which could not have foreseen by a diligent contracting authority or contracting entity, the contracting authority or contracting entity should, exceptionally, be able to modify the order of the award criteria to take into account the new possibilities brought about by that innovative solution, provided such a modification ensures equal treatment of all actual or potential tenderers by issuing a new invitation to tender or, where appropriate, publishing a new concession notice.
Dans des cas exceptionnels, lorsque le pouvoir adjudicateur ou l’entité adjudicatrice reçoit une offre proposant une solution innovante présentant des performances fonctionnelles d’un niveau exceptionnel, qui n’aurait pas pu être prévue malgré la diligence du pouvoir adjudicateur ou de l’entité adjudicatrice, le pouvoir adjudicateur ou l’entité adjudicatrice devrait, à titre exceptionnel, pouvoir modifier l’ordre des critères d’attribution afin de tenir compte des nouvelles possibilités offertes par cette solution innovante, pour autant que cette modification garantisse l’égalité de traitement de tous les soumissionnaires existants ou potentiels en diffusant une nouvelle invitation à soumissionner ou, selon le cas, en publiant un nouvel avis de concession.

5. By way of derogation from paragraph 1, the contracting authority or contracting entity shall not be required to publish a new concession notice where no applications, no tenders, no suitable tenders or no suitable applications have been submitted in response to a prior concession procedure, provided that the initial conditions of the concession contract are not substantially altered and that a report is sent to the Commission, where it so requests.
5. Par dérogation au paragraphe 1, le pouvoir adjudicateur ou l’entité adjudicatrice n’est pas tenu de publier un nouvel avis de concession lorsque aucune candidature, aucune offre ou aucune offre appropriée n’a été déposée en réponse à une procédure de concession antérieure, pour autant que les conditions initiales du contrat de concession ne soient pas substantiellement modifiées et qu’un rapport soit communiqué à la Commission à sa demande.

A new concession procedure is required in the case of material changes to the initial concession, in particular to the scope and content of the mutual rights and obligations of the parties, including the distribution of intellectual property rights.
