En outre, le Tribunal: 5o) a jugé à tort que les requérantes devaient établir une baisse constatée de leur chiffre d’affaires pour avoir qualité à agir; 6o) a rejeté des effets négatifs établis au motif d’autres causes d’effets négatifs non précisées; 7o) n’a pas tenu compte du fait que les conditions pour introduire un recours doivent être assouplies, car la décision de la Commission d’autoriser la mesure d’aide, en application de l’article 107, paragraphe 3, sous c), TFUE, n’a pas fait l’objet d’un véritable examen administratif préalable.

In particular, it submits that the General Court in no way dealt with the appellant’s main complaint, which was conceded at the hearing before that Court, that the Commission had not individually examined the hardship cases that Germany had submitted to it.

In the appellants’ view, the Commission’s decision is unlawful in that, in actual fact, the aid was characterised by the incentive effect, a fact which the Commission should have verified even if the applications for aid had been submitted after the work had started.
