Any person who is granted a refund of duties under section 74, 76 or 79 shall be granted, in addition to the refund, interest on the refund at the prescribed rate for the period beginning on the ninety-first day after the day an application for the refund is received in accordance with paragraph 74(3)(b) and ending on the day the refund is granted.
80. (6) If the result of a reassessment on an objection to, or a decision on an appeal from, an assessment is to reduce the amount of duty payable by a person and, by reason of the reduction, any refund or other payment claimed by the person for a reporting period, or in an application for a refund or other payment, should be decreased, the Minister may at any time assess or reassess that reporting period or that application only for the purpose of taking the reduction of duty into account in respect of the refund or other payment.
(6) Dans le cas où une nouvelle cotisation établie par suite d’une opposition à une cotisation ou d’une décision d’appel concernant une cotisation réduit les droits exigibles d’une personne et, de façon incidente, réduit le remboursement ou autre paiement demandé par la personne pour une période de déclaration ou dans une demande de remboursement ou d’autre paiement, le ministre peut, en tout temps, établir une cotisation ou une nouvelle cotisation pour cette période ou cette demande, mais seulement pour tenir compte de l’incidence de la réduction des droits.
