This [INSTRUMENT] constitutes a development of the provisions of the Schengen acquis in which Ireland does not take part, in accordance with Council Decision 2002/192/EC of 28 February 2002 concerning Ireland's request to take part in some of the provisions of the Schengen acquis*. Ireland is therefore not taking part in its adoption and is not bound by it or subject to its application.

For instance, in Ireland, according to information provided at a meeting of an Irish Parliamentary Committee in February 2009, the prices of products sold in Ireland and in the UK respectively can differ by up to 130 %, with Irish retailers being obliged to procure on the basis of the price list applying to Ireland.

The other Member States shall be entitled to exercise at their frontiers or at any point of entry into their territory such controls on persons seeking to enter their territory from the United Kingdom or any territories whose external relations are under its responsibility for the same purposes stated in Article 1 of this Protocol, or from Ireland as long as the provisions of Article 1 of this Protocol apply to Ireland.

In that case, the normal treaty provisions will apply to Ireland.

Accordingly, as long as they maintain such arrangements, the provisions of Article 1 of this Protocol shall apply to Ireland under the same terms and conditions as for the United Kingdom.
