The Commission may apply this paragraph to products of the cereals and rice sectors that are exported in the form of processed goods in accordance with Council Regulation (EC) No 1216/2009 (5).

For the purposes of applying paragraph 1(a) and (b), and without prejudice to the forms of behaviour set out in paragraph 2, Annex I defines non-exhaustive indicators relating to the employment of a fictitious device or any other form of deception or contrivance, and non-exhaustive indicators related to false or misleading signals and to price securing.

Paragraphs 1 and 2 of this Article may be applied, in whole or in part, to products listed in points (c) and (d) of Article 1 and to products listed in Article 1 and exported in the form of goods listed in Annex III. In that case, the adjustment referred to in paragraph 1 of this Article shall be corrected by applying to the monthly increase a coefficient expressing the ratio between the quantity of basic product and the quantity thereof contained in the processed product exported or used in the goods exported.

1. The Governments of the Member States shall adopt all appropriate general or special measures to ensure that the scales, rates and all other tariff rules of every kind applied to the carriage of coal and steel within each Member State and between the Member States are published or brought to the knowledge of the High Authority to such extent and in such manner and form as to: (a) ensure that transport undertakings apply scales, rates and all other tariff rules of every kind which afford comparable price conditions to comparably placed consumers (Article 4 (b) and the first and second paragraphs of Article 70 of the Treaty);
