These documents had the objective of recalling certain provisions of Regulation 1164/94 and set rules to ensure the respect of the principle of sound financial management: The arrangements for the payment of the 20% payment on account; the procedure for implementing the repayment, in whole or in part, of the payment on account (“M+12 rule”); the procedure to be applied under Art.C5 of Annex II of Reg. 1164/94 (“M+24 rule”); the guidelines for the amendments of decisions on Cohesion Fund projects; the transition arrangements from ISPA to Cohesion Fund for the Member States concerned.

2. Member States may continue to apply bilateral arrangements concerning administrative cooperation between their competent authorities as regards the application and monitoring of the terms and conditions of employment applicable to posted workers referred to in Article 3 of Directive 96/71/EC, in so far as these arrangements do not adversely affect the rights and obligations of the workers and companies concerned.

Les États membres peuvent continuer d'appliquer les accords bilatéraux de coopération administrative entre leurs autorités compétentes en ce qui concerne l'application et la surveillance des conditions de travail et d'emploi applicables aux travailleurs détachés visées à l'article 3 de la directive 96/71/CE, pour autant que ces accords ne portent pas atteinte aux droits et obligations des travailleurs et des entreprises concernées.

2. Where appropriate and in accordance with the principles established in Directive 96/71/EC, Member States are free to apply bilateral arrangements concerning administrative cooperation and mutual assistance between their competent authorities as regards the enforcement of Directive 96/71/EC and this Directive, in so far as these arrangements do not adversely affect the rights and obligations of the workers and companies concerned.

Everything that contributes to better protection must, therefore, be welcomed and, once again, very important arrangements are being proposed to us, which I support: a national monitoring centre for security at sea and increased staff training, not forgetting the adequate equipping of ports – so many measures for which we have called many times in this House. That is what I think is important, even if I agree with my fellow MEPs in asking for these arrangements to be applied in a balanced and harmonious way, without compromising the actual activity of the ports.
