This question of how to apply for legal aid abroad is, at least in theory, relatively simple to solve, since all the Member States of the Union, with the exception of Germany, have ratified the 1977 Agreement of the Council of Europe on the Transmission of Applications for legal aid, known generally as the Strasbourg agreement.

A second series of amendments seeks to clarify the scope of the Directive by specifying: the persons to whom it applies (the Directive must also apply to legal persons – as criminal proceedings conducted against legal persons must benefit from the same comprehensive approach as proceedings against physical persons – and to persons summoned or questioned as witnesses who become, or are liable to become, suspects during the course of questioning); when it applies (the Directive must apply from the time a person becomes a suspect or an accused person, at all stages in the proceedings and up until the final conclusion of those proceedings); and the cases to which it applies (the Directive must apply to proceedings in ‘criminal matters’ as defined in the ECHR).

That finding cannot be called into question by the wording of Article 97(4) of the Rules of Procedure, which provides that the introduction of an application for legal aid suspends the period prescribed for the bringing of the action until the date of notification of the order making a decision on that application, because in the present case the applicant did not apply for legal aid until 18 November 2009, that is to say, when the time-limits for bringing actions against all three of the abovementioned decisions of the selection board had already expired.

What is important as far as the practical implementation is concerned, is that both the EU Commission and the Member States have the political will in this particular instance not only to identify violations of human rights and hence of a fundamental part of the treaty, but also to apply the legal consequences provided for, which generally start with consultation and may lead to the suspension of parts or even the cancellation of the entire treaty.
