152.29 If any payment is made by a person to the Minister of National Revenue on account of taxes specified in section 228 of the Income Tax Act and of a premium under this Part in respect of self-employed earnings, despite any direction made by the person making the payment with respect to its application, the part of the payment that would be applied under that section in payment of tax under the Income Tax Act is, subject to section 37 of the Canada Pension Plan, to be applied in payment of a premium under this Part and is deemed to be a payment on account of the premium, and to the extent of the amount so applied, does not discharge liability for tax under the Income Tax Act, and any amount then remaining is to be applied in payment of tax under the Income Tax Act and discharges the liability of the person making the payment for that tax to the extent of that amount.

(4) Any amount paid by a contributor who revokes an election is applied in payment of the amount referred to in subsection (2) and the remainder is applied in payment of any part of the period of service that remains credited to the contributor, the amount to be paid being calculated in accordance with the provisions of the Act under which the election was made and the remainder, if any, being refunded to the contributor.

22 (1) Where a lessee holds a lease of a location acquired by assignment or otherwise under the provisions of these Regulations, on land situated more than 10 miles from a railway when the lease was issued, and where the lessee can show that he has expended in actual prospecting and developing operations on such location by recognized methods during any year, prior to railway communication with any such location having been established, an amount equal to or in excess of the prescribed yearly rental of such location, the Minister, upon proof satisfactory to him that such expenditure was incurred for the purpose and in the manner specified, may waive payment of the rental for the year of the term during which such expenditure may be shown to have been incurred, or in case the rental has already been paid, he may apply such payment or such portion thereof as to him seems reasonable on account of future payments of the rental of any such location, such expenditure, however, shall not be accepted as rental for a total of more than five years during the term of any lease.
22 (1) Si un concessionnaire détient une concession d’emplacement acquise par cession ou autrement sous le régime du présent règlement, sur une terre qui était située à plus de 10 milles d’un chemin de fer au moment où la concession a été accordée, et si le concessionnaire peut démontrer qu’il a dépensé en travaux effectifs de prospection et d’aménagement sur ledit emplacement, selon des méthodes reconnues, durant toute année antérieure à l’établissement de communications ferroviaires avec ledit emplacement, un montant égal ou supérieur à la redevance fixe annuelle attachée à cet emplacement, le ministre peut, s’il est prouvé à sa satisfaction que cette dépense a été faite aux fins et de la manière spécifiées, renoncer au paiement de la redevance fixe pour l’année de la durée pendant laquelle il peut être démontré que cette dépense a été effectuée, ou bien si la redevance fixe a déjà été acquittée, il peut appliquer ce paiement ou toute partie d’icelui qui lui semble raisonnable à des paiements futurs de la redevance fixe visant un tel emplacement; ladite dépense ne doit cependant pas être acceptée en guise de redevance fixe pour un total de plus de cinq années de la durée de toute concession.

Where a farmer should be entitled to receive payment entitlements or increase the value of the existing ones by virtue of a definitive court's ruling or by virtue of a definitive administrative act of the competent authority of a Member State, the farmer shall receive the number and value of payment entitlements established in that ruling or act at a date to be fixed by the Member State but not later than the latest date for lodging an application under the single payment scheme following the date of the ruling or the act and taking into account the application of Article 44(3) of Regulation (EC) No 1782/2003. ►M9 Article 42(8) of that Regulation shall not apply to payment entitlements allocated under this Article.
