(4) Each member of the Council may appoint a judge of that member’s court to be a substitute member of the Council and the substitute member shall act as a member of the Council during any period in which he or she is appointed to act, but the Chief Justice of Canada may, in lieu of appointing a member of the Supreme Court of Canada, appoint any former member of that Court to be a substitute member of the Council.

(3) Where the Minister has been required to refer a decision to a New Drug Committee pursuant to subsection (2), he shall appoint a member of the New Drug Committee, the dissatisfied manufacturer shall appoint a member of the New Drug Committee and the two members so appointed shall appoint a third member of the New Drug Committee who shall be chairman, or, if they are unable to do so within a reasonable time, the Minister shall appoint a third member of the New Drug Committee who shall be chairman.

4. If a member is absent or unable to act, the association or council that appointed the member may appoint a temporary substitute member to act during the period that the member is absent or unable to act, and if the member who is absent or unable to act is a primary producer in Canada appointed from a list of nominees from a provincial cattle association, the temporary substitute member must be an active primary producer in Canada appointed from a list of nominees from that association.
4. En cas d’absence ou d’empêchement d’un membre, l’association ou le conseil qui l’a nommé peut nommer un membre suppléant pour agir à sa place pour la durée de son absence ou de son empêchement. (3) Where the employer or a union fails or neglects to appoint a member of a Commission within seven days after receiving the notice referred to in subsection (2), the Minister shall appoint, as a member of the Commission, a person whom the Minister considers to be qualified to be such a member, and the member so appointed shall be deemed to have been appointed by the employer or the union, as the case may be.

(b) The Councillor and Alternate Councillor appointed by the member, or in whose appointment the member has participated, shall cease to hold office, provided that, if such Councillor was entitled to cast the number of votes allotted to other members whose voting rights have not been suspended, another Councillor and Alternate Councillor shall be appointed by such other members under Schedule D, and, pending such appointment, the Councillor and Alternate Councillor shall continue to hold office, but for a maximum of thirty days from the date of the suspension.

Appointed representatives appointed in Member States which avail themselves of the option under Article 31 are not allowed to carry out part or all of the credit intermediation activities set out in point 5 of Article 4 or to provide advisory services in Member States where such appointed representatives are not allowed to operate.
