This prevents Canadians from being subjected to any form of unjustified arbitrary detention, which is exactly what happened to Japanese-Canadians, as then Prime Minister Mackenzie King acknowledged in 1944 when he said:

It is also true, however, that this constitutional reform contains three elements that impair its credibility. First of all, it ceases to class as crimes actions that are still crimes because they fulfil the conditions as such. Secondly, the constitution is being reformed, but other laws remain in force, such as the Penal Code, the anti-terrorism law and the audiovisual law, which continue to uphold the existence of certain crimes of expression, of opinion, of public demonstration and association. Thirdly, and most importantly, the constitutional reform is not being put into practice. Arbitrary detentions and violations of human rights continue to take place.

The second major concern is a violation of the right to be free from arbitrary detention and the right to liberty — both of which are protected in our Charter — and arbitrary detention of people who are aged 16 or older, with a possibility that children will be detained.
