The United Kingdom is taking part in this [INSTRUMENT], in accordance with Article 5(1) of Protocol No 19 on the Schengen acquis integrated into the framework of the European Union, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis*.

2. The Commission shall be empowered to adopt delegated acts in accordance with Article 139 concerning rules establishing the cases where and the conditions under which the CHED must accompany consignments of the categories of animals and goods referred to in Article 45(1) to the place of destination.

The Commission shall be empowered to adopt delegated acts in accordance with Article 45 concerning the elements to be taken into account in order to assess the dependency link, the criteria for establishing the existence of proven family links, the criteria for assessing the capacity of the person concerned to take care of the dependent person and the elements to be taken into account in order to assess the inability to travel for a significant period of time.

La Commission est habilitée à adopter des actes délégués en conformité avec l’article 45 en ce qui concerne les éléments à prendre en considération pour évaluer le lien de dépendance, les critères permettant d’établir l’existence de liens familiaux avérés, les critères permettant d’évaluer la capacité de la personne concernée à prendre soin de la personne à charge et les éléments à prendre en considération pour évaluer l’incapacité du demandeur à se déplacer pendant un temps assez long.

5. The Commission shall be empowered to adopt delegated acts in accordance with Article 45 concerning the identification of family members, siblings or relatives of the unaccompanied minor; the criteria for establishing the existence of proven family links; the criteria for assessing the capacity of a relative to take care of the unaccompanied minor, including where family members, siblings or relatives of the unaccompanied minor stay in more than one Member State.

(27) This Directive respects the fundamental rights and observes the principles recognised in the Charter of Fundamental Rights of the European Union, notably the freedom to choose an occupation and the right to engage in work (Article 15), the right to non-discrimination (Article 21 and in particular Paragraph 1 concerning non-discrimination on the ground of sex and Paragraph 2 concerning non-discrimination on the grounds of nationality), the right to collective bargaining and action (Article 28), fair and just working conditions (Article 31), the right to freedom of movement and residence (Article 45) and the right to an effective remedy and a fair trial (Article 47).

Recalls that under the terms of Article 14(9) of the Rules governing the payment of expenses and allowances to Members "The European Parliament shall draw up a list of the names of all assistants which shall be open to the public for inspection"; notes the opinion of the Committee on Legal Affairs and the Internal Market that in accordance with Article 9 of Regulation (EC) No 45/2001 such personal information may only be disclosed if the data subject has given his consent; shares the concern of the European Ombudsman that Parliament's decision to publish a register of MEP's assistants "has been thrown into question by the argument that data protection gives assistants the right to remain anonymous even whilst being paid from European taxpayer's money";

The competent authority of the Member States may require from the applicant further information concerning both the particulars supplied pursuant to Article 45 and the qualified person referred to in Article 52; where the competent authority concerned exercises this right, application of the time-limits referred to in Articles 47 and 48 shall be suspended until the additional data required have been supplied.
