The Commission has examined the compatibility of the aid on the basis of the derogation provided for in Article 87(3) of the EC Treaty (former Article 92(3)) and has looked into whether the derogation applies under the guidelines on national regional aid and the guidelines on state aid for rescuing and restructuring firms in difficulty.

According to Article 87 (formerly Article 92) of the EC Treaty, "any aid granted by a Member State or through state resources in any form whatsoever which distorts or threatens to distort competition by favouring certain undertakings or the production of certain goods shall, in so far as it affects trade between Member States, be incompatible with the common market".
