[75] Under Article 87, paragraph 3 of the Treaty, certain areas have a derogation from the principle that state aid is incompatible with the common market. Point 'a' of the paragraph states that aid aimed at encouraging economic development in regions in which the standard of living is unusually low or there is a serious level of under-employment can be considered compatible with the common market.

(FR) Article 4 of the draft regulation of the Commission on the application of Articles 87 and 88 of the EC Treaty to national regional aid for initial investment lays down the conditions that must be fulfilled by aid for initial investment in order to be declared compatible with the Common Market within the meaning of Article 87, paragraph 3 of the Treaty and to be exempted from the obligation of notification laid down by Article 88, paragraph 3 of the Treaty.

As a matter of principle, State aid is generally forbidden by the EC Treaty, unless it can be found compatible under the exemptions provided for by Article 87, paragraphs 2 and 3, and, for companies entrusted with a public service mission, Article 86, paragraph 2.
