This [INSTRUMENT] constitutes a development of the provisions of the Schengen acquis in which Ireland does not take part, in accordance with Council Decision 2002/192/EC of 28 February 2002 concerning Ireland's request to take part in some of the provisions of the Schengen acquis*. Ireland is therefore not taking part in its adoption and is not bound by it or subject to its application.

The legal basis of the economic policy conditions is Article 3(5) of Council Regulation (EU) No 407/2010 establishing a European financial stabilisation mechanism and Article 2(2) of the Council Implementing Decision 2011/77/EU on granting Union financial assistance to Ireland.

Furthermore, data show that mobile EU citizens account for a very small share of recipients of special non-contributory benefits, which are benefits combining features of social security and social assistance at the same time: less than 1 % of all beneficiaries (who are EU citizens) in six countries (Austria, Bulgaria, Estonia, Greece, Malta and Portugal); between 1 % and 5 % in five other countries (Germany, Finland, France, the Netherlands and Sweden), and above 5 % in Belgium and Ireland (although figures for Ireland are estimates based on claims)[22].

(2) The second strand of policy followed by Member States refers to the possibility to combine the receipt of the benefit entitlement with earnings from work (labour supply channel) by allowing the following: (i) combination of part-time or full-time job with partial unemployment benefit or unemployment assistance (Spain, Ireland, Portugal) or with a wide range of other social benefit schemes such as normal and specific unemployment benefits, RMI, lone-parent allowance, ASS and disabled adult allowance (France); and (ii) incentives to start-up business or to encourage self-employment by allowing to receive the unemployment benefit in a lump sum payment (Spain).
