In a Communication and a proposal to amend Article 2 (4) of Directive 76/207/EEC, which were adopted today, the Commission takes the view that the Court has only condemned the special feature of the Bremen law which automatically gave women an absolute and unconditional right to appointment or promotion over men in sectors where they were under-represented provided their qualifications were the same.
Dans une communication et une proposition de modification de l'article 2 paragraphe 4 de la directive 76/207/CEE, qui ont été adoptés aujourd'hui, la Commission considère que la Cour n'a fait que condamner la caractéristique particulière de la législation de Brême qui, à qualifications égales, accorde automatiquement aux femmes une priorité absolue et inconditionnelle en matière de nomination ou de promotion dans les secteurs où elles sont sous-représentées.
