On 16 December 2015, the General Court declared that the European Commission has breached EU law by failing to adopt measures concerning the specification of scientific criteria for the determination of endocrine-disrupting properties pursuant to Regulation (EU) No 528/2012 concerning the making available on the market and use of biocidal products (Case T-521/14 Sweden v Commission).
Le 16 décembre 2015, le Tribunal de l'Union européenne a dit pour droit que la Commission avait manqué aux obligations qui lui incombaient en vertu du règlement (UE) n° 528/2012 concernant la mise à disposition sur le marché et l'utilisation des produits biocides (affaire T-521/14, Royaume de Suède contre Commission), en s'abstenant d'adopter des actes en ce qui concerne la spécification des critères scientifiques pour la détermination des propriétés perturbant le système endocrinien.

1. In specific cases where a veterinary medicinal product or a biocidal product needs to be authorised as a matter of urgency for reasons relating to the protection of public health or of animal health or welfare, the Commission, any person who has submitted an application for an opinion pursuant to Article 3 or a Member State may ask the Agency to carry out an accelerated procedure for the assessment of the maximum residue limit of a pharmacologically active substance contained in those products.

The EU legislation for Plant Protection Products and Biocidal Products provides that active substances which are endocrine disruptors shall not be approved, unless – in the case of Plant Protection Products – there is negligible exposure or – in the case of Biocides – a negligible risk.

Notwithstanding Article 89, where the competent authority or, in the case of a biocidal product authorised at Union level, the Commission, cancels or amends an authorisation or decides not to renew it, it shall grant a period of grace for the making available on the market and use of existing stocks, except in cases where continued making available on the market or use of the biocidal product would constitute an unacceptable risk to human health, animal health or the environment.

(33) When biocidal products are being authorised, it is necessary to ensure that, when properly used for the purpose intended, they are sufficiently effective and have no unacceptable effect on the target organisms such as resistance, and, in the case of vertebrate animals, unnecessary suffering and pain, and have, in the light of current scientific and technical knowledge, no unacceptable effect on the environment and on human or animal health. When deciding whether a biocidal product should be authorised, due consideration should be given to the benefits resulting from its use.

By way of derogation from Article 15, an experiment or a test for the purposes of research or development involving the placing on the market of an unauthorised biocidal product or an active substance intended exclusively for use in a biocidal product may only take place in the case of scientific research and development or in the case of product and process-oriented research and development, and under the conditions laid down in the second and third subparagraphs of this paragraph.

In the case of a biocidal product which has already been authorised in accordance with Articles 15, 25 or 28, and where all periods of protection of information according to Article 49 have expired, the receiving competent authority or the Agency may agree that a subsequent applicant for authorisation may refer to data provided by the first applicant, and if the periods of protection of information according to Article 49 have not expired, the receiving competent authority or the Agency may agree that a subsequent applicant for authorisation may refer to data provided by the first applicant pursuant to Article 52, in both cases in so far as the subsequent applicant can provide evidence that the biocidal product is similar to, and its active substances technically equivalent to, the one formerly authorised, including in terms of degree of purity and nature of impurities.

- in the case of a biocidal product produced outside the Community, the person established within the Community and designated by the manufacturer of that biocidal product as his sole representative for the purposes of this Regulation or, where no such person has been so designated, the importer into the Community of that biocidal product;

Member States shall appoint a body or bodies responsible for receiving information on biocidal products which have been placed on the market, including information on the chemical composition of such products, and for making such information available in cases where suspected poisoning arises from biocidal products.
