3. Considers that football has suffered from the absence of a clear, stable and predictable legal framework; notes, moreover, that sport is having to deal with a number of disputes, bearing on the legality of its structures and rules, which are likely to cast doubt on the very organisation of the European sports model; therefore calls on the Commission, the Member States and the football authorities to define, in close consultation, an appropriate legal framework in the light of the Independent European Sport Review 2006, so as to prevent further disputes and ensure that the Court of Justice does not determine the future of professional football in Europe; recommends that the framework take as its basis the recognition of the specific nature of sport and of the principles necessary to safeguard fairness and solidarity, and its educative function, and the implementation of harmonised rules guaranteeing healthy competition between European clubs and a level playing field; takes the view, however, that the approach to professional football should not be governed by legal and financial considerations alone; the social and educational dimensions are also important;
3. considère que le football a souffert de l'absence d'un cadre juridique clair, stable et prévisible; note de surcroît que le sport doit faire face à de nombreux contentieux portant sur la légalité de ses structures et de ses règles, qui sont de nature à remettre en cause l'organisation même du modèle sportif européen; invite par conséquent la Commission, les États membres et les autorités du football à définir en étroite concertation un cadre juridique approprié à la lumière du Rapport Indépendant sur le Sport Européen (2006) afin d'éviter de nouveaux contentieux et que la Cour de justice ne détermine l'avenir du football professionnel en Europe; recommande que le cadre soit axé sur la prise en compte de la spécificité du sport et des principes nécessaires à la sauvegarde de l'équité, de la solidarité et de la fonction éducative, ainsi que la mise en place de règles harmonisées assurant la saine concurrence entre les différents clubs européens et permettant une égalité des chances dans les compétitions; affirme cependant que l'approche du football professionnel ne doit pas être uniquement juridique et financière et que sa dimension sociale et éducative est tout aussi importante;

Notes that paragraph 2 of the protocol on the institutions with the prospect of enlargement of the European Union requires that, before the twenty-first Member State joins, there should be a ‘comprehensive review of the provisions of the Treaties on the composition and functioning of the institutions’, and that, in view of this, the mandate for a future IGC should not be confined to the points evoked in the conclusions of the Cologne European Council; more particularly, calls on the Council to make a thorough examination of the role of the European Council;
12. constate que le paragraphe 2 du protocole relatif aux institutions dans la perspective de l’élargissement de l’Union européenne prévoit, avant l’adhésion du 21ème État, un “réexamen complet des dispositions des traités relatives à la composition et au fonctionnement des institutions” ce qui exige que le mandat confié à une future CIG ne soit pas limité aux points évoqués dans les conclusions du Conseil européen de Cologne; exige que la méthode communautaire soit appliquée en ce qui concerne la réforme du Traité; demande plus particulièrement au Conseil de procéder à un examen approfondi du rôle du Conseil européen;

(4) Whereas it is appropriate to allow risk capital participation in investment funds with a priority focus on providing risk capital for trans-European network projects up to 1 % of the overall amount for the period 2000 to 2006 in order to gain experience with this new form of financing; whereas this limit may be increased up to 2 % following a review of the functioning of this instrument; whereas it is also appropriate to examine its possible future extension;
(4) il convient de permettre la participation au capital à risque dans des fonds d'investissement fournissant prioritairement des capitaux à risque pour des projets de réseaux transeuropéens jusqu'à concurrence de 1 % du montant total pour la période 2000-2006 afin d'acquérir une expérience avec cette nouvelle forme de financement; cette limite peut être portée jusqu'à 2 %, à la suite d'un réexamen du fonctionnement de cet instrument; il convient aussi d'examiner son éventuelle extension future;
