Within four weeks of the lifting of border control at internal borders, the Member State which has carried out border control at internal borders shall present a report to the European Parliament, the Council and the Commission on the reintroduction of border control at internal borders, outlining, in particular, the initial assessment and the respect of the criteria referred to in Articles 23a, 25 and 26a, the operation of the checks, the practical cooperation with neighbouring Member States, the resulting impact on the free movement of persons, the effectiveness of the reintroduction of border control at internal borders, including an ex-post assessment of the proportionality of the reintroduction of border control.

If by 30 June 2017, there are still cross-border and sea-basin programmes under the ENI and cross-border programmes under the IPA II which have not been submitted to the Commission, the entire contribution from the ERDF referred to in paragraph 4 to those programmes for the remaining years up to 2020, which has not been re-allocated to another adopted programme under the same category of external cooperation programmes, shall be allocated to the internal cross-border cooperation programmes under point (a) of paragraph 1 in which the Member State or Member States concerned participates or participate.

7. In 2015 and 2016, the annual contribution from the ERDF to the programmes under the ENI and the IPA II, for which no programme has been submitted to the Commission by 30 June under the cross-border and sea-basin programmes under the ENI, and under the cross-border programmes under the IPA II, and which has not been re-allocated to another programme submitted under the same category of external cooperation programmes, shall be allocated to the internal cross-border cooperation programmes under point (a) of paragraph 1 in which the Member State or Member States concerned participates or participate.
7. The Member State which has reintroduced border control at internal borders under Article 23 shall confirm the date on which that control is lifted and, at the same time or soon afterwards, present a report to the European Parliament, the Council and the Commission on the reintroduction of border control at internal borders, outlining, in particular, the operation of the checks and the effectiveness of the reintroduction of border control.

The rights and obligations of the merging companies arising from contracts of employment or from employment relationships and existing at the date on which the cross-border merger takes effect shall, by reason of that cross-border merger taking effect, be transferred to the company resulting from the cross-border merger on the date on which the cross-border merger takes effect.

– (PT) I voted in favour of this report for the following reasons, which are quite brief. Firstly, the importance of the Commission communication which, in discussing the better management of the EU’s external borders, links the action of the Member States to measures of a European nature, which are actually crucial, given the threats posed in particular by organised crime, terrorism and illegal immigration, as well as the imminent entry into the EU of new countries. Secondly, the positive approach of the rapporteur, who continually emphasises that the management of our borders is still a national competence and must be applied at the national level.
- (PT) Voici les raisons pour lesquelles j'ai voté pour ce rapport : premièrement, en raison de l'importance de la communication de la Commission qui, se penchant sur une meilleure gestion des frontière extérieures, associe à l'action des États membres des mesures à caractère européen, réellement indispensables compte tenu des menaces que représentent notamment la criminalité organisée, le terrorisme et l'immigration illégale, sans oublier l'entrée imminente de nouveaux pays au sein de l'UE ; deuxièmement, en raison de l'approche positive adoptée par le rapporteur qui souligne que la gestion de nos frontières demeure une compétence nationale et doit être exercée au niveau national.

It is, however, not so much the current situation which gives rise to most concern but rather the possible impact of an enlargement on these regions which currently lie directly at the EU’s external borders The adjacent regions in the applicant countries have an altogether lower per capita GDP in purchasing power parity. Above all, the cost of living and labour costs are appreciably lower in those regions.

– (EL) Mr President, it is particularly worrying to see armed conflict persisting in a country which borders my own country at a time when intensive negotiations are under way for the sole purpose of settling once and for all the differences which gave rise to the conflict in the first place. Ethnic segregation, penning nations in after a war or uprising behind fortified borders which no-one considers definitive and which in turn become a new source of conflict is, unfortunately, the pattern which has been repeated throughout the history of this region in the Balkans.
- (EL) Monsieur le Président, c’est avec une vive inquiétude que nous voyons, dans un pays qui a une frontière commune avec le mien, se poursuivre les affrontements armés au moment où se déroulent des négociations intensives visant précisément à régler définitivement les différends qui ont provoqué les affrontements. La séparation des peuples, leur confinement à la suite d’une guerre ou d’une révolution derrière des frontières fortifiées que personne, en outre, ne considère comme définitives, si bien qu’elles finissent à leur tour par être source de nouveaux conflits, constituent malheureusement l’expérience historique de notre région dans les Balkans.

The Council understands the concern expressed by the honourable Member but wishes to emphasise that, according to the information to which the Council has access, Mr Haekkerup’s decision does not relate to tariffs (which can only be imposed at external borders which, in this case, consist of the border with the former Yugoslav republics of Macedonia and Albania).
Le Conseil comprend l'inquiétude exprimée par l'honorable parlementaire, mais il voudrait souligner que, d'après les informations dont il dispose, la décision de M. The two sides are not equal: on the one hand, there is a State, which has never defined its borders, which is expanding its settlements and has one of the strongest armies in the world; on the other, there is an occupied people and an occupied territory, without either State or army, which is unable even to exercise any control over bean imports, let alone borders: since 29 September, this people has been besieged, bombed, its villages sealed off, with its sick dying at military check points, its doctors and nurses attacked and its parliament unable to meet.
La partie n'est pas égale : d'un côté nous avons un État qui n'a jamais défini ses frontières, multiplie les colonies et possède une des armées les plus puissantes du monde ; de l'autre, un peuple et un territoire occupés, sans État ni armée, qui ne peut exercer aucun contrôle sur quoi que ce soit, pas même sur l'importation des haricots, et je ne parle pas de ses frontières : depuis le 29 septembre cet État est assiégé, bombardé, cloîtré dans les villages, où les malades meurent aux points de contrôle militaires ; où les médecins et les infirmiers sont agressés, où les parlementaires ne peuvent se réunir.
