H. whereas, as a result of the Rana Plaza disaster and the public outcry that followed, various initiatives were taken aimed at improving the situation in the RMG sector in Bangladesh; whereas these initiatives include the Sustainability Compact, which, together with Bangladesh, the EU signed in July 2013, the ‘Accord on fire and building safety’ between brands and trade unions, which was signed in May 2013, and the ‘Understanding for a practical arrangement on payments to the victims of the Rana Plaza accident and their families’ (Rana Plaza Arrangement), which was signed in November 2013;

Welcomes the Accord on Fire and Building Safety in Bangladesh between the trade unions, NGOs and about 40 multinational textile retailers, finalised on 15 May 2013, which aims to improve safety standards at production sites (and which covers the arrangements for paying for such measures) in particular by establishing an independent inspection system, including public reports and mandatory repairs and renovations, and actively supporting the creation of ‘health and safety committees’ involving workers’ representatives in each factory; calls on all other relevant textile brands to support this effort, including textile retailers Walmart and Gap, which continue to reject any binding agreement;

The airlines of each Party shall not be precluded from entering into franchise or branding arrangements, including conditions relating to brand protection and operational matters, provided that: they comply, in particular, with the applicable laws and regulations concerning control; the ability of the airline to exist outside of the franchise is not jeopardised; the arrangement does not result in a foreign airline engaging in cabotage operations; and applicable regulations, such as consumer protection provisions, including those regarding the disclosure of the identity of the airline operating the service, are complied with.

8. The airlines of each Party shall be entitled to enter into franchising or branding arrangements with companies, including airlines, of either Party or third countries, provided that the airlines hold the appropriate authority and meet the conditions prescribed under the laws and regulations normally applied by the Parties to such arrangements.
