One issue raised by some national enforcers was whether, in order to penalise a trader for a breach of Articles 6 to 9 of the UCPD, it had to be demonstrated that the conduct was in breach of ‘professional diligence’. The Commission considers that there is no such need and that professional diligence is automatically violated in the event of a misleading action, omission or aggressive practice.
