D. whereas as a result the case was referred back to the Central District Court of Buda, which acquitted Ágnes Hankiss of the charges on 6 February 2009; whereas an appeal was brought by the plaintiff against this judgment in the Budapest Municipal Court, which on 25 March 2009 decided to uphold the judgment of the District Court on all its grounds,

Appeal brought against the judgment of the Court of First Instance (now the General Court) (Eighth Chamber, Extended Composition) of 11 June 2009 in Case T-189/03 ASM Brescia SpA v Commission by which the General Court dismissed the action brought for annulment of Articles 2 and 3 of Commission Decision 2003/193/EC of 5 June 2002 on State aid granted by Italy in the form of tax exemptions and subsidised loans to public utilities with a majority public capital holding (OJ 2003 L 77, p. 21).
Pourvoi formé contre l'arrêt du Tribunal de première instance (huitième chambre élargie) du 11 juin 2009, ASM Brescia SpA/Commission (T-189/03),par lequel le Tribunal a rejeté une demande d'annulation des art. 2 et 3 de la décision 2003/193/CE de la Commission, du 5 juin 2002, relative à un aide d'État aux exonérations fiscales et prêts à des conditions préférentielles consentis par l'Italie à des entreprises de services publics dont l'actionnariat est majoritairement public (JO L 77, p. 21).
