The 2005 Act of accession of Bulgaria and Romania has introduced a simplified system for the accession of Bulgaria and Romania to these conventionsOn the basis of Article 3(3) and 3(4) of the Act of Accession, the Council must adopt a decision in order to determine the date on which these conventions shall enter into force for Bulgaria and Romania and to make all the necessary adjustments to these conventions.
L'acte de 2005 relatif à l'adhésion de la Bulgarie et de la Roumanie a introduit une procédure simplifiée pour l'adhésion de ces deux pays à ces conventions. (10) The entry conditions laid down in Article 5(1) of Regulation (EC) N°562/2006 of the European Parliament and of the Council of 15 March 2006 establishing a Community Code on the rules governing the movement of persons across borders (Schengen Borders Code) have to be fulfilled, with the exception of the condition laid down in Article 5(1)(b) thereof, insofar as this Decision extending the common rules provided in Decision N° 895/2006/EC, sets up a regime of unilateral recognition by Bulgaria and Romania of certain documents issued by Member States fully implementing the Schengen acquis, similar documents issued by Member States not yet fully implementing the Schengen acquis as well as short term visas, long term visas and residence permits issued by Bulgaria and Romania for the purpose of transit and, in addition, enables the Czech Republic, Cyprus, Hungary, Latvia, Malta, Poland, Slovenia and Slovakia, which apply the simplified regime introduced by Decision N° 895/2006/EC, to recognise similar documents issued by Bulgaria and Romania.
(10) Les conditions d'entrée fixées à l'article 5, paragraphe 1, du règlement (CE) n° 562/2006 du Parlement européen et du Conseil du 15 mars 2006 établissant un code communautaire relatif au régime de franchissement des frontières par les personnes (code frontières Schengen) doivent être remplies, à l'exception de la condition énoncée à son article 5, paragraphe 1, point b), dans la mesure où la présente décision étendant les règles communes prévues dans la décision n° 895/2006/CE instaure un régime de reconnaissance unilatérale par la Bulgarie et la Roumanie de certains documents délivrés par les États membres qui mettent en œuvre l'intégralité de l'acquis de Schengen, des documents similaires délivrés par les États membres qui ne mettent pas encore en œuvre l'intégralité de cet acquis, ainsi que des visas de court séjour et des visas et titres de long séjour délivrés par la Bulgarie et la Roumanie aux fins de transit, et, en outre, permet à la République tchèque, à Chypre, à la Lettonie, à la Hongrie, à Malte, à la Pologne, à la Slovénie et la Slovaquie, qui appliquent le régime simplifié introduit par la décision n° 895/2006/CE, de reconnaître les documents similaires délivrés par la Bulgarie et la Roumanie.

1. The Convention, the Protocol of 27 September 1996 and the Protocol of 29 November 1996 shall enter into force in relation to Bulgaria and Romania on the first day of the first month following the date of adoption of this Decision, unless they have already entered into force for Bulgaria or Romania before that date.

For the Bulgaria and Romania, the state of play at the end of 2004 was the following: both Bulgaria and Romania had completed EDIS Stage 1 (Gap assessment) and had progressed onto Stage 2 (Gap plugging), with the target to move to EDIS during the first half of 2006.
